國務院辦公廳印發《提升行政執法質量三年行動計劃(2023-2025年)》

  新(xin)華社北京9月(yue)5日電 近日,國務院(yuan)辦公廳(ting)印發《提升行(xing)(xing)政執(zhi)法(fa)質量三年(nian)行(xing)(xing)動(dong)計劃(hua)(2023-2025年(nian))》(以下簡(jian)稱《行(xing)(xing)動(dong)計劃(hua)》),就全面提升行(xing)(xing)政執(zhi)法(fa)質量和效能提出(chu)明確要(yao)求。

  《行(xing)(xing)(xing)(xing)動計(ji)劃(hua)》指出,行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)執(zhi)(zhi)法(fa)(fa)是行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)機關(guan)履行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)府(fu)(fu)職能(neng)、管(guan)理經濟(ji)社(she)會事(shi)務的重要方式,行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)執(zhi)(zhi)法(fa)(fa)質量(liang)直接關(guan)系法(fa)(fa)治政(zheng)(zheng)(zheng)府(fu)(fu)建設(she)成(cheng)效。《行(xing)(xing)(xing)(xing)動計(ji)劃(hua)》的制(zhi)定實施,對于提(ti)高(gao)行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)執(zhi)(zhi)法(fa)(fa)隊伍(wu)能(neng)力素質,規(gui)范(fan)行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)執(zhi)(zhi)法(fa)(fa)行(xing)(xing)(xing)(xing)為(wei),完(wan)善行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)執(zhi)(zhi)法(fa)(fa)體制(zhi)機制(zhi),強化行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)執(zhi)(zhi)法(fa)(fa)監督問責,全(quan)面推進(jin)嚴格(ge)規(gui)范(fan)公正文明執(zhi)(zhi)法(fa)(fa),防止不作(zuo)為(wei)亂作(zuo)為(wei),更(geng)好保護(hu)(hu)人民群眾合法(fa)(fa)權益,維護(hu)(hu)公平競爭市場秩序,加快推進(jin)法(fa)(fa)治政(zheng)(zheng)(zheng)府(fu)(fu)建設(she),具(ju)有(you)重要意(yi)義。

  《行(xing)動計劃》強(qiang)調,要堅(jian)持(chi)以習近平(ping)新時(shi)代中(zhong)國(guo)特色社會主義思想為指導,深(shen)入學(xue)習貫徹習近平(ping)法(fa)治思想,全面貫徹落實黨(dang)的(de)二十(shi)大精神,深(shen)刻領悟“兩個(ge)確立(li)”的(de)決(jue)定(ding)性(xing)意義,增強(qiang)“四個(ge)意識(shi)”、堅(jian)定(ding)“四個(ge)自信”、做到(dao)“兩個(ge)維護”。要堅(jian)持(chi)黨(dang)的(de)領導、執法(fa)為民(min)、問題(ti)導向(xiang)、注重實效(xiao)、統(tong)籌協調等原則,通過三(san)年時(shi)間狠抓落實,使行(xing)政執法(fa)質量(liang)和(he)效(xiao)能(neng)顯著提(ti)高,行(xing)政執法(fa)的(de)權威性(xing)和(he)公信力有(you)力增強(qiang),人(ren)民(min)群眾對行(xing)政執法(fa)的(de)滿意度(du)大幅上升。

提(ti)升行政執法質量

行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)執法(fa)是行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)機關(guan)履行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)府(fu)職能、管理經(jing)濟社(she)會事務的(de)重(zhong)要方式,行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)執法(fa)質量直接關(guan)系法(fa)治政(zheng)(zheng)(zheng)(zheng)府(fu)建設成效。為深入貫徹(che)落(luo)實《法(fa)治政(zheng)(zheng)(zheng)(zheng)府(fu)建設實施綱要(2021—2025年)》,全面(mian)提(ti)升(sheng)行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)執法(fa)質量和效能,制定本(ben)計劃。

一、總(zong)體(ti)要求

(一)指導思想。以習近平新(xin)時代中國特色(se)社會主(zhu)義思想為(wei)指導,深入學習貫(guan)徹習近平法(fa)治(zhi)思想,全(quan)面貫(guan)徹落實黨的二十大精神,深刻(ke)領(ling)悟“兩(liang)個確(que)立”的決定性意(yi)義,增強(qiang)“四個意(yi)識(shi)”、堅定“四個自(zi)信(xin)”、做(zuo)到“兩(liang)個維護”,以提升行(xing)(xing)(xing)政(zheng)執(zhi)(zhi)法(fa)質量和效能(neng)為(wei)目(mu)標(biao),著力提高(gao)行(xing)(xing)(xing)政(zheng)執(zhi)(zhi)法(fa)隊(dui)伍(wu)能(neng)力素質,規范(fan)行(xing)(xing)(xing)政(zheng)執(zhi)(zhi)法(fa)行(xing)(xing)(xing)為(wei),完善行(xing)(xing)(xing)政(zheng)執(zhi)(zhi)法(fa)體制機制,強(qiang)化(hua)行(xing)(xing)(xing)政(zheng)執(zhi)(zhi)法(fa)監督問責(ze),全(quan)面推進嚴格規范(fan)公正(zheng)文明執(zhi)(zhi)法(fa),防止不作(zuo)為(wei)亂作(zuo)為(wei),更好保(bao)護人民群眾合(he)法(fa)權(quan)益,維護公平競爭市場秩序,加(jia)快(kuai)推進法(fa)治(zhi)政(zheng)府(fu)建(jian)設。

(二(er))工作原則。堅持黨(dang)的(de)(de)(de)領導(dao),把堅持和(he)(he)加強(qiang)(qiang)黨(dang)的(de)(de)(de)領導(dao)貫穿于行(xing)(xing)政(zheng)執(zhi)(zhi)(zhi)法(fa)(fa)(fa)工(gong)作的(de)(de)(de)全(quan)過程和(he)(he)各方面。堅持執(zhi)(zhi)(zhi)法(fa)(fa)(fa)為(wei)民,努力(li)讓人(ren)民群眾在(zai)每一個執(zhi)(zhi)(zhi)法(fa)(fa)(fa)行(xing)(xing)為(wei)中(zhong)(zhong)都能(neng)看到(dao)風清(qing)氣正、從每一項執(zhi)(zhi)(zhi)法(fa)(fa)(fa)決(jue)定(ding)中(zhong)(zhong)都能(neng)感受到(dao)公平正義。堅持問題導(dao)向,聚(ju)焦重點領域行(xing)(xing)政(zheng)執(zhi)(zhi)(zhi)法(fa)(fa)(fa)中(zhong)(zhong)存(cun)在(zai)的(de)(de)(de)突出問題,查找根源,切(qie)實(shi)解決(jue)。堅持注重實(shi)效(xiao),立足(zu)基層行(xing)(xing)政(zheng)執(zhi)(zhi)(zhi)法(fa)(fa)(fa)實(shi)際(ji),增強(qiang)(qiang)措施(shi)的(de)(de)(de)針對性和(he)(he)實(shi)效(xiao)性,穩步提升行(xing)(xing)政(zheng)執(zhi)(zhi)(zhi)法(fa)(fa)(fa)質量。堅持統籌協調,著力(li)增強(qiang)(qiang)系(xi)統性、整(zheng)體性、協同性,推動行(xing)(xing)政(zheng)執(zhi)(zhi)(zhi)法(fa)(fa)(fa)與政(zheng)府管(guan)理其他各項工(gong)作協調發(fa)展(zhan)。

(三)主要目標。到2025年底,行(xing)(xing)政(zheng)執(zhi)(zhi)(zhi)法(fa)(fa)突出問題得到有效(xiao)整治,行(xing)(xing)政(zheng)執(zhi)(zhi)(zhi)法(fa)(fa)工作體系進一步完善,行(xing)(xing)政(zheng)執(zhi)(zhi)(zhi)法(fa)(fa)隊伍素質明顯(xian)提升,行(xing)(xing)政(zheng)執(zhi)(zhi)(zhi)法(fa)(fa)監督(du)機制和能力(li)建設(she)切實強化,行(xing)(xing)政(zheng)執(zhi)(zhi)(zhi)法(fa)(fa)信(xin)息化、數字化水(shui)平進一步提升,行(xing)(xing)政(zheng)執(zhi)(zhi)(zhi)法(fa)(fa)質量(liang)和效(xiao)能顯(xian)著(zhu)提高(gao),行(xing)(xing)政(zheng)執(zhi)(zhi)(zhi)法(fa)(fa)的(de)權威性和公信(xin)力(li)有力(li)增強,人民群眾對行(xing)(xing)政(zheng)執(zhi)(zhi)(zhi)法(fa)(fa)的(de)滿意度大(da)幅(fu)上升。

二、重點任務

(一)全面提升行(xing)政執法人員能力(li)素質

1.著力(li)提(ti)高政(zheng)(zheng)(zheng)治能(neng)力(li)。各(ge)級行(xing)(xing)政(zheng)(zheng)(zheng)執法(fa)(fa)機(ji)關要把(ba)加(jia)強(qiang)(qiang)黨的政(zheng)(zheng)(zheng)治建設放(fang)在首位(wei)(wei),切實踐行(xing)(xing)習近(jin)平(ping)法(fa)(fa)治思想,堅(jian)定擁護(hu)(hu)“兩個(ge)確立”、堅(jian)決做到“兩個(ge)維護(hu)(hu)”,正確把(ba)握政(zheng)(zheng)(zheng)治方(fang)向(xiang),嚴格(ge)遵(zun)守政(zheng)(zheng)(zheng)治紀(ji)律(lv)(lv),加(jia)強(qiang)(qiang)政(zheng)(zheng)(zheng)治歷練(lian),積累政(zheng)(zheng)(zheng)治經驗(yan),不斷提(ti)高政(zheng)(zheng)(zheng)治判斷力(li)、政(zheng)(zheng)(zheng)治領悟力(li)、政(zheng)(zheng)(zheng)治執行(xing)(xing)力(li)。加(jia)強(qiang)(qiang)基層行(xing)(xing)政(zheng)(zheng)(zheng)執法(fa)(fa)單位(wei)(wei)黨組織建設,充分發(fa)揮黨建引(yin)領作用。推進行(xing)(xing)政(zheng)(zheng)(zheng)執法(fa)(fa)隊(dui)伍的革(ge)命(ming)化、正規(gui)化、專業化、職(zhi)業化建設,持(chi)續提(ti)升做好行(xing)(xing)政(zheng)(zheng)(zheng)執法(fa)(fa)工作的能(neng)力(li)素(su)養(yang)和本(ben)領,實現行(xing)(xing)政(zheng)(zheng)(zheng)執法(fa)(fa)工作政(zheng)(zheng)(zheng)治效果(guo)、法(fa)(fa)律(lv)(lv)效果(guo)和社會效果(guo)的有機(ji)統一。

2.大力提升業(ye)(ye)務(wu)能(neng)力。建(jian)立健全(quan)行(xing)政(zheng)(zheng)(zheng)(zheng)執(zhi)法(fa)(fa)標準(zhun)化(hua)制度化(hua)培(pei)訓(xun)機(ji)制,開展(zhan)分類分級分層培(pei)訓(xun),在完(wan)成(cheng)政(zheng)(zheng)(zheng)(zheng)治理論教育(yu)和黨性教育(yu)學時的基礎上,確保行(xing)政(zheng)(zheng)(zheng)(zheng)執(zhi)法(fa)(fa)人(ren)(ren)(ren)(ren)員(yuan)(yuan)每人(ren)(ren)(ren)(ren)每年接受不少(shao)于60學時的公共法(fa)(fa)律知識、業(ye)(ye)務(wu)知識和行(xing)政(zheng)(zheng)(zheng)(zheng)執(zhi)法(fa)(fa)技能(neng)培(pei)訓(xun),原則上于2024年6月前完(wan)成(cheng)對本(ben)地區、本(ben)部(bu)門行(xing)政(zheng)(zheng)(zheng)(zheng)執(zhi)法(fa)(fa)隊(dui)伍(wu)的全(quan)員(yuan)(yuan)輪(lun)訓(xun)。加強(qiang)執(zhi)法(fa)(fa)行(xing)為規范和職業(ye)(ye)道(dao)德(de)教育(yu)。國務(wu)院司法(fa)(fa)行(xing)政(zheng)(zheng)(zheng)(zheng)部(bu)門要(yao)推進全(quan)國行(xing)政(zheng)(zheng)(zheng)(zheng)執(zhi)法(fa)(fa)人(ren)(ren)(ren)(ren)員(yuan)(yuan)培(pei)訓(xun)標準(zhun)化(hua)體系建(jian)設。國務(wu)院有(you)關部(bu)門要(yao)研究制定(ding)本(ben)系統行(xing)政(zheng)(zheng)(zheng)(zheng)執(zhi)法(fa)(fa)人(ren)(ren)(ren)(ren)員(yuan)(yuan)的專(zhuan)門業(ye)(ye)務(wu)培(pei)訓(xun)計劃(hua)。上級業(ye)(ye)務(wu)部(bu)門要(yao)加強(qiang)對下級業(ye)(ye)務(wu)部(bu)門培(pei)訓(xun)工(gong)作的指導(dao),鄉鎮、街道(dao)綜(zong)合(he)執(zhi)法(fa)(fa)人(ren)(ren)(ren)(ren)員(yuan)(yuan)要(yao)參加上級有(you)關業(ye)(ye)務(wu)部(bu)門組織的培(pei)訓(xun),對承擔多個(ge)部(bu)門行(xing)政(zheng)(zheng)(zheng)(zheng)執(zhi)法(fa)(fa)事項人(ren)(ren)(ren)(ren)員(yuan)(yuan)的培(pei)訓(xun),鼓勵跨部(bu)門聯合(he)開展(zhan)。培(pei)訓(xun)工(gong)作務(wu)求實效,堅(jian)決避(bi)免各種形式主(zhu)義(yi),切(qie)實提升一線執(zhi)法(fa)(fa)人(ren)(ren)(ren)(ren)員(yuan)(yuan)運用法(fa)(fa)治思維和法(fa)(fa)治方式開展(zhan)執(zhi)法(fa)(fa)、維護穩(wen)定(ding)、化(hua)解矛(mao)盾(dun)的能(neng)力。

3.切實(shi)加(jia)強全方位管理。嚴格落實(shi)行(xing)政(zheng)執法(fa)(fa)人(ren)員(yuan)(yuan)資格管理和持證上崗制(zhi)度(du),未(wei)取得(de)行(xing)政(zheng)執法(fa)(fa)證件(jian)的(de)人(ren)員(yuan)(yuan)不得(de)獨立從事行(xing)政(zheng)執法(fa)(fa)工作。全面(mian)落實(shi)行(xing)政(zheng)執法(fa)(fa)責(ze)任(ren)制(zhi),健全完善(shan)行(xing)政(zheng)執法(fa)(fa)人(ren)員(yuan)(yuan)年度(du)考核制(zhi)度(du)。建立健全行(xing)政(zheng)執法(fa)(fa)人(ren)員(yuan)(yuan)退(tui)出機制(zhi),對(dui)不符合執法(fa)(fa)要(yao)(yao)求的(de)行(xing)政(zheng)執法(fa)(fa)人(ren)員(yuan)(yuan)要(yao)(yao)依法(fa)(fa)暫(zan)扣(kou)、收回或者(zhe)注銷其行(xing)政(zheng)執法(fa)(fa)證件(jian)。人(ren)民(min)(min)警察證件(jian)的(de)管理使用按(an)照人(ren)民(min)(min)警察法(fa)(fa)的(de)規定執行(xing)。按(an)照國家有關規定對(dui)在(zai)行(xing)政(zheng)執法(fa)(fa)中做出突出貢獻的(de)集體和個(ge)人(ren)給予表彰獎(jiang)勵,推進(jin)示范創建活動。

(二)全面推進嚴格(ge)規范公(gong)正文(wen)明執法(fa)

1.強力整(zheng)(zheng)(zheng)治行(xing)(xing)(xing)(xing)政(zheng)執(zhi)(zhi)(zhi)法(fa)(fa)突出問(wen)題(ti)(ti)(ti)。聚焦人民群眾(zhong)反(fan)映強烈(lie)的運動(dong)式執(zhi)(zhi)(zhi)法(fa)(fa)、“一(yi)刀切”執(zhi)(zhi)(zhi)法(fa)(fa)、簡單粗暴執(zhi)(zhi)(zhi)法(fa)(fa)、野蠻執(zhi)(zhi)(zhi)法(fa)(fa)、過度執(zhi)(zhi)(zhi)法(fa)(fa)、機械執(zhi)(zhi)(zhi)法(fa)(fa)、逐利執(zhi)(zhi)(zhi)法(fa)(fa)等不作為(wei)(wei)亂作為(wei)(wei)問(wen)題(ti)(ti)(ti),開(kai)(kai)展(zhan)(zhan)專(zhuan)(zhuan)(zhuan)項(xiang)整(zheng)(zheng)(zheng)治和監督行(xing)(xing)(xing)(xing)動(dong)。各地(di)區(qu)有關部(bu)(bu)(bu)(bu)(bu)門(men)(men)要于(yu)2023年(nian)底前梳理形(xing)成(cheng)本(ben)地(di)區(qu)各行(xing)(xing)(xing)(xing)政(zheng)執(zhi)(zhi)(zhi)法(fa)(fa)領域的突出問(wen)題(ti)(ti)(ti)清(qing)單,并對照清(qing)單適時組織(zhi)開(kai)(kai)展(zhan)(zhan)專(zhuan)(zhuan)(zhuan)項(xiang)整(zheng)(zheng)(zheng)治行(xing)(xing)(xing)(xing)動(dong),專(zhuan)(zhuan)(zhuan)項(xiang)整(zheng)(zheng)(zheng)治情(qing)況報(bao)送本(ben)級(ji)(ji)司(si)(si)法(fa)(fa)行(xing)(xing)(xing)(xing)政(zheng)部(bu)(bu)(bu)(bu)(bu)門(men)(men)匯總(zong)(zong)。實行(xing)(xing)(xing)(xing)垂直管(guan)理或者雙(shuang)重領導(dao)并以上級(ji)(ji)單位(wei)領導(dao)為(wei)(wei)主的國務院(yuan)部(bu)(bu)(bu)(bu)(bu)門(men)(men)的行(xing)(xing)(xing)(xing)政(zheng)執(zhi)(zhi)(zhi)法(fa)(fa)突出問(wen)題(ti)(ti)(ti)專(zhuan)(zhuan)(zhuan)項(xiang)整(zheng)(zheng)(zheng)治情(qing)況,由(you)垂直管(guan)理或者雙(shuang)重領導(dao)并以上級(ji)(ji)單位(wei)領導(dao)為(wei)(wei)主部(bu)(bu)(bu)(bu)(bu)門(men)(men)匯總(zong)(zong)后報(bao)送國務院(yuan)司(si)(si)法(fa)(fa)行(xing)(xing)(xing)(xing)政(zheng)部(bu)(bu)(bu)(bu)(bu)門(men)(men)。2024年(nian)底前,由(you)國務院(yuan)司(si)(si)法(fa)(fa)行(xing)(xing)(xing)(xing)政(zheng)部(bu)(bu)(bu)(bu)(bu)門(men)(men)牽頭,組織(zhi)有關地(di)方和部(bu)(bu)(bu)(bu)(bu)門(men)(men)對各地(di)區(qu)專(zhuan)(zhuan)(zhuan)項(xiang)整(zheng)(zheng)(zheng)治情(qing)況開(kai)(kai)展(zhan)(zhan)專(zhuan)(zhuan)(zhuan)項(xiang)監督,并將專(zhuan)(zhuan)(zhuan)項(xiang)監督情(qing)況向國務院(yuan)報(bao)告。

2.建立健全行(xing)政執(zhi)(zhi)法(fa)標準(zhun)(zhun)規(gui)范。全面(mian)落實行(xing)政裁(cai)(cai)(cai)量(liang)權(quan)(quan)基(ji)準(zhun)(zhun)制度(du),加強行(xing)政裁(cai)(cai)(cai)量(liang)權(quan)(quan)基(ji)準(zhun)(zhun)的動態管理和備(bei)案審查(cha)。2023年底前普遍建立行(xing)政裁(cai)(cai)(cai)量(liang)權(quan)(quan)基(ji)準(zhun)(zhun)制度(du)。國務院司法(fa)行(xing)政部(bu)門要(yao)會同有關(guan)部(bu)門圍繞行(xing)政處(chu)罰(fa)、行(xing)政檢查(cha)、行(xing)政強制等執(zhi)(zhi)法(fa)種類,分批制定統一的行(xing)政執(zhi)(zhi)法(fa)文書(shu)基(ji)本(ben)格式(shi)標準(zhun)(zhun),研究(jiu)制定行(xing)政執(zhi)(zhi)法(fa)裝(zhuang)備(bei)配備(bei)標準(zhun)(zhun)及技術規(gui)范指引。

3.完善(shan)行(xing)政(zheng)執(zhi)法(fa)(fa)(fa)(fa)(fa)工作(zuo)(zuo)機(ji)制(zhi)(zhi)(zhi)。嚴格行(xing)政(zheng)執(zhi)法(fa)(fa)(fa)(fa)(fa)程(cheng)序(xu),全(quan)(quan)面落(luo)實行(xing)政(zheng)執(zhi)法(fa)(fa)(fa)(fa)(fa)公(gong)示制(zhi)(zhi)(zhi)度(du)(du)、執(zhi)法(fa)(fa)(fa)(fa)(fa)全(quan)(quan)過程(cheng)記錄制(zhi)(zhi)(zhi)度(du)(du)、重大執(zhi)法(fa)(fa)(fa)(fa)(fa)決(jue)定法(fa)(fa)(fa)(fa)(fa)制(zhi)(zhi)(zhi)審核(he)制(zhi)(zhi)(zhi)度(du)(du)。依(yi)法(fa)(fa)(fa)(fa)(fa)健全(quan)(quan)以信用(yong)為(wei)基(ji)礎的(de)新型執(zhi)法(fa)(fa)(fa)(fa)(fa)機(ji)制(zhi)(zhi)(zhi),規(gui)范涉(she)企(qi)行(xing)政(zheng)檢(jian)(jian)查,完善(shan)聯合(he)檢(jian)(jian)查、“雙隨機(ji)、一公(gong)開”監管、非(fei)現場執(zhi)法(fa)(fa)(fa)(fa)(fa)等工作(zuo)(zuo)機(ji)制(zhi)(zhi)(zhi),推動(dong)監管信息(xi)共享互認,避(bi)免(mian)多(duo)(duo)頭執(zhi)法(fa)(fa)(fa)(fa)(fa)、重復檢(jian)(jian)查;對直接涉(she)及公(gong)共安全(quan)(quan)和人民(min)群眾生命(ming)健康等的(de)特殊行(xing)業(ye)(ye)、重點領域,依(yi)法(fa)(fa)(fa)(fa)(fa)依(yi)規(gui)實行(xing)全(quan)(quan)覆蓋的(de)重點監管。綜合(he)運用(yong)多(duo)(duo)種方式督促引(yin)導受處(chu)罰(fa)企(qi)業(ye)(ye)加強合(he)規(gui)管理(li)、及時整改違法(fa)(fa)(fa)(fa)(fa)問題,防止以罰(fa)代管。探索建立涉(she)企(qi)行(xing)政(zheng)執(zhi)法(fa)(fa)(fa)(fa)(fa)案件(jian)經濟影響評(ping)估制(zhi)(zhi)(zhi)度(du)(du),依(yi)法(fa)(fa)(fa)(fa)(fa)降低行(xing)政(zheng)執(zhi)法(fa)(fa)(fa)(fa)(fa)對企(qi)業(ye)(ye)的(de)負面影響。完善(shan)涉(she)民(min)營企(qi)業(ye)(ye)行(xing)政(zheng)執(zhi)法(fa)(fa)(fa)(fa)(fa)違法(fa)(fa)(fa)(fa)(fa)行(xing)為(wei)投訴舉報(bao)處(chu)理(li)機(ji)制(zhi)(zhi)(zhi),依(yi)法(fa)(fa)(fa)(fa)(fa)保(bao)護民(min)營企(qi)業(ye)(ye)和企(qi)業(ye)(ye)家權益。

(三)健全完善(shan)行政(zheng)執法工作體系

1.協調推(tui)進行(xing)(xing)(xing)(xing)政(zheng)(zheng)執(zhi)法(fa)(fa)(fa)體(ti)(ti)制(zhi)改革(ge)。地方各(ge)級司法(fa)(fa)(fa)行(xing)(xing)(xing)(xing)政(zheng)(zheng)部門(men)要切(qie)實履(lv)行(xing)(xing)(xing)(xing)行(xing)(xing)(xing)(xing)政(zheng)(zheng)執(zhi)法(fa)(fa)(fa)體(ti)(ti)制(zhi)改革(ge)的法(fa)(fa)(fa)治協調職責,督促指導各(ge)級行(xing)(xing)(xing)(xing)政(zheng)(zheng)執(zhi)法(fa)(fa)(fa)部門(men)于(yu)2024年底前研究制(zhi)定(ding)本部門(men)行(xing)(xing)(xing)(xing)政(zheng)(zheng)執(zhi)法(fa)(fa)(fa)事項(xiang)目錄。國(guo)務(wu)院(yuan)有(you)(you)關部門(men)和省、自治區、直轄市人民政(zheng)(zheng)府要組織開展(zhan)行(xing)(xing)(xing)(xing)政(zheng)(zheng)執(zhi)法(fa)(fa)(fa)事項(xiang)的清理(li)工作,對雖有(you)(you)法(fa)(fa)(fa)定(ding)依(yi)據(ju)但近五年未發(fa)生的、極少發(fa)生且(qie)沒有(you)(you)實施必要的、交(jiao)叉(cha)重復的等行(xing)(xing)(xing)(xing)政(zheng)(zheng)執(zhi)法(fa)(fa)(fa)事項(xiang)進行(xing)(xing)(xing)(xing)清理(li),提出擬取消、調整(zheng)或者暫停實施的意見,按規(gui)定(ding)程序處理(li)。國(guo)務(wu)院(yuan)有(you)(you)關部門(men)制(zhi)定(ding)本領域綜合(he)行(xing)(xing)(xing)(xing)政(zheng)(zheng)執(zhi)法(fa)(fa)(fa)標準(zhun)化指南,國(guo)務(wu)院(yuan)司法(fa)(fa)(fa)行(xing)(xing)(xing)(xing)政(zheng)(zheng)部門(men)研究制(zhi)定(ding)綜合(he)行(xing)(xing)(xing)(xing)政(zheng)(zheng)執(zhi)法(fa)(fa)(fa)改革(ge)法(fa)(fa)(fa)治建設政(zheng)(zheng)策(ce)文件。

2.做好鄉鎮(zhen)、街(jie)道(dao)賦(fu)權(quan)(quan)(quan)有關(guan)工作。省、自治區、直轄市(shi)人民政府司法行(xing)政部門要加強對(dui)(dui)賦(fu)權(quan)(quan)(quan)鄉鎮(zhen)、街(jie)道(dao)行(xing)政執(zhi)法事項(xiang)的(de)法制(zhi)審核,指導、監(jian)督同級有關(guan)行(xing)政部門分(fen)區域、分(fen)類別依法研究提出可以賦(fu)權(quan)(quan)(quan)的(de)行(xing)政執(zhi)法事項(xiang)清(qing)單。對(dui)(dui)擬予(yu)(yu)清(qing)理(li)的(de)行(xing)政執(zhi)法事項(xiang)不再(zai)賦(fu)權(quan)(quan)(quan)鄉鎮(zhen)、街(jie)道(dao)。完善(shan)賦(fu)權(quan)(quan)(quan)事項(xiang)評(ping)(ping)估(gu)和(he)動(dong)態(tai)調整制(zhi)度,各地區2024年底前要對(dui)(dui)已經下放鄉鎮(zhen)、街(jie)道(dao)的(de)行(xing)政執(zhi)法事項(xiang)至少進行(xing)一(yi)次評(ping)(ping)估(gu),對(dui)(dui)基層接不住、監(jian)管跟(gen)不上(shang)的(de)及時予(yu)(yu)以調整。各地區要組(zu)織開展(zhan)鄉鎮(zhen)、街(jie)道(dao)行(xing)政執(zhi)法規范化試點。

3.大力(li)推進行(xing)政(zheng)(zheng)執法(fa)(fa)(fa)(fa)協(xie)作。健(jian)全(quan)事(shi)前(qian)事(shi)中(zhong)事(shi)后(hou)監管有效(xiao)銜(xian)接(jie)機(ji)制(zhi)。建立健(jian)全(quan)跨部門、跨區域、跨層(ceng)級的(de)行(xing)政(zheng)(zheng)執法(fa)(fa)(fa)(fa)協(xie)作機(ji)制(zhi),實現(xian)違(wei)法(fa)(fa)(fa)(fa)線索互聯(lian)、執法(fa)(fa)(fa)(fa)標準互通、處理(li)結果互認。完善行(xing)政(zheng)(zheng)執法(fa)(fa)(fa)(fa)管轄、法(fa)(fa)(fa)(fa)律適用(yong)等爭(zheng)議協(xie)調(diao)機(ji)制(zhi)。健(jian)全(quan)行(xing)政(zheng)(zheng)執法(fa)(fa)(fa)(fa)與刑事(shi)司(si)法(fa)(fa)(fa)(fa)銜(xian)接(jie)機(ji)制(zhi)。加強行(xing)政(zheng)(zheng)執法(fa)(fa)(fa)(fa)機(ji)關(guan)與紀檢監察機(ji)關(guan)的(de)協(xie)作配合,及(ji)時依(yi)規依(yi)紀依(yi)法(fa)(fa)(fa)(fa)移送(song)行(xing)政(zheng)(zheng)執法(fa)(fa)(fa)(fa)過程中(zhong)發現(xian)的(de)有關(guan)問題線索。

(四)加(jia)快構建行政(zheng)執法協調監(jian)督工作體系

1.完善行(xing)政(zheng)執(zhi)法(fa)(fa)監(jian)(jian)督(du)(du)制(zhi)度。加快出(chu)臺行(xing)政(zheng)執(zhi)法(fa)(fa)監(jian)(jian)督(du)(du)條例(li),進(jin)一步(bu)規范行(xing)政(zheng)執(zhi)法(fa)(fa)監(jian)(jian)督(du)(du)體制(zhi)、監(jian)(jian)督(du)(du)職責(ze)、監(jian)(jian)督(du)(du)內容、監(jian)(jian)督(du)(du)方(fang)式、監(jian)(jian)督(du)(du)程序(xu)、責(ze)任(ren)體系等內容。健(jian)全完善行(xing)政(zheng)執(zhi)法(fa)(fa)監(jian)(jian)督(du)(du)配(pei)套工(gong)作制(zhi)度,推進(jin)行(xing)政(zheng)執(zhi)法(fa)(fa)案卷(juan)評查、行(xing)政(zheng)執(zhi)法(fa)(fa)案例(li)指(zhi)(zhi)導等工(gong)作。研究制(zhi)定(ding)科學、合理的行(xing)政(zheng)執(zhi)法(fa)(fa)考(kao)核評價指(zhi)(zhi)標(biao)體系,提高相關指(zhi)(zhi)標(biao)的針(zhen)對(dui)性、約束力。

2.健(jian)全(quan)行(xing)政(zheng)(zheng)執(zhi)法監(jian)督機(ji)制(zhi)。強化(hua)上級(ji)行(xing)政(zheng)(zheng)機(ji)關(guan)(guan)對(dui)下(xia)級(ji)行(xing)政(zheng)(zheng)機(ji)關(guan)(guan)行(xing)政(zheng)(zheng)執(zhi)法工(gong)作(zuo)的(de)全(quan)方位、全(quan)流程(cheng)監(jian)督,嚴格(ge)履(lv)行(xing)常態化(hua)、長效化(hua)監(jian)督,2024年底前基本建成制(zhi)度完善、機(ji)制(zhi)健(jian)全(quan)、職責明確、監(jian)督有力(li)、運轉高效的(de)省(sheng)市縣(xian)鄉(xiang)四(si)級(ji)全(quan)覆蓋(gai)的(de)行(xing)政(zheng)(zheng)執(zhi)法協(xie)調監(jian)督工(gong)作(zuo)體系(xi)。積(ji)極探索司(si)法所協(xie)助縣(xian)級(ji)人(ren)民政(zheng)(zheng)府司(si)法行(xing)政(zheng)(zheng)部門開(kai)展鄉(xiang)鎮、街道行(xing)政(zheng)(zheng)執(zhi)法監(jian)督工(gong)作(zuo)的(de)方式方法。

3.創(chuang)新行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)執(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)監(jian)(jian)督(du)(du)(du)方(fang)式。縣級(ji)以上人(ren)民政(zheng)(zheng)(zheng)府司法(fa)(fa)(fa)(fa)行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)部門(men)要(yao)制(zhi)定年(nian)度行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)執(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)監(jian)(jian)督(du)(du)(du)工(gong)作方(fang)案(an),綜合運(yun)用行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)執(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)工(gong)作報告、統(tong)計分析、評(ping)議考核等方(fang)式,對行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)執(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)工(gong)作情況開展經常(chang)性監(jian)(jian)督(du)(du)(du),督(du)(du)(du)促行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)執(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)機關全面履行(xing)(xing)(xing)(xing)行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)執(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)職(zhi)能。縣級(ji)以上人(ren)民政(zheng)(zheng)(zheng)府部門(men)承(cheng)擔行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)執(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)監(jian)(jian)督(du)(du)(du)職(zhi)責的(de)(de)機構,要(yao)加強(qiang)對本部門(men)本系統(tong)行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)執(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)工(gong)作和重大行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)執(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)案(an)事件(jian)的(de)(de)統(tong)籌協調(diao)、日常(chang)監(jian)(jian)督(du)(du)(du)和業務指導。完(wan)善重大行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)執(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)案(an)件(jian)專項監(jian)(jian)督(du)(du)(du)調(diao)查處理機制(zhi)。拓寬監(jian)(jian)督(du)(du)(du)渠(qu)道,建立行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)執(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)監(jian)(jian)督(du)(du)(du)與(yu)12345政(zheng)(zheng)(zheng)務服務便(bian)民熱線等監(jian)(jian)督(du)(du)(du)渠(qu)道的(de)(de)信息共享工(gong)作機制(zhi)。積極(ji)推(tui)進落(luo)實行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)執(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)監(jian)(jian)督(du)(du)(du)員制(zhi)度。

(五)健全行政執法和行政執法監督(du)科技保障體系

1.推(tui)進(jin)(jin)行(xing)政(zheng)(zheng)執(zhi)法(fa)(fa)(fa)和(he)行(xing)政(zheng)(zheng)執(zhi)法(fa)(fa)(fa)監(jian)督(du)信(xin)息系統(tong)(tong)建設(she)。國(guo)(guo)務院司法(fa)(fa)(fa)行(xing)政(zheng)(zheng)部(bu)門要加快推(tui)進(jin)(jin)全國(guo)(guo)行(xing)政(zheng)(zheng)執(zhi)法(fa)(fa)(fa)綜合管理監(jian)督(du)信(xin)息系統(tong)(tong)應(ying)用(yong),構建行(xing)政(zheng)(zheng)執(zhi)法(fa)(fa)(fa)和(he)行(xing)政(zheng)(zheng)執(zhi)法(fa)(fa)(fa)監(jian)督(du)一(yi)體(ti)化平臺(tai)。按照(zhao)國(guo)(guo)家(jia)統(tong)(tong)籌、省級(ji)組織、省市兩級(ji)集中(zhong)部(bu)署、省市縣(xian)鄉四級(ji)一(yi)體(ti)化應(ying)用(yong)方(fang)式,推(tui)進(jin)(jin)行(xing)政(zheng)(zheng)執(zhi)法(fa)(fa)(fa)和(he)行(xing)政(zheng)(zheng)執(zhi)法(fa)(fa)(fa)監(jian)督(du)一(yi)體(ti)化平臺(tai)集約(yue)化建設(she)和(he)部(bu)署應(ying)用(yong),推(tui)行(xing)行(xing)政(zheng)(zheng)執(zhi)法(fa)(fa)(fa)移(yi)動應(ying)用(yong)程序(xu)(APP)掌上執(zhi)法(fa)(fa)(fa)。

2.推進行(xing)(xing)政(zheng)(zheng)執(zhi)(zhi)法(fa)(fa)數(shu)據(ju)(ju)互聯(lian)互通(tong)。推進行(xing)(xing)政(zheng)(zheng)執(zhi)(zhi)法(fa)(fa)和行(xing)(xing)政(zheng)(zheng)執(zhi)(zhi)法(fa)(fa)監(jian)督(du)(du)一(yi)體化平(ping)臺與國家“互聯(lian)網+監(jian)管”系(xi)統(tong)、全(quan)(quan)國信用信息共(gong)享平(ping)臺、“雙(shuang)隨機、一(yi)公開”系(xi)統(tong)等數(shu)據(ju)(ju)標(biao)準(zhun)的(de)相互兼容,形成全(quan)(quan)國統(tong)一(yi)的(de)行(xing)(xing)政(zheng)(zheng)執(zhi)(zhi)法(fa)(fa)數(shu)據(ju)(ju)標(biao)準(zhun)體系(xi)。建立(li)健全(quan)(quan)全(quan)(quan)國行(xing)(xing)政(zheng)(zheng)執(zhi)(zhi)法(fa)(fa)數(shu)據(ju)(ju)歸集共(gong)享機制,深化行(xing)(xing)政(zheng)(zheng)執(zhi)(zhi)法(fa)(fa)大數(shu)據(ju)(ju)分(fen)析運用,加(jia)快推進各地(di)區和國務院有關部(bu)門業務系(xi)統(tong)與全(quan)(quan)國行(xing)(xing)政(zheng)(zheng)執(zhi)(zhi)法(fa)(fa)綜合管理監(jian)督(du)(du)信息系(xi)統(tong)執(zhi)(zhi)法(fa)(fa)數(shu)據(ju)(ju)的(de)互聯(lian)互通(tong),2025年底(di)前匯聚形成全(quan)(quan)國行(xing)(xing)政(zheng)(zheng)執(zhi)(zhi)法(fa)(fa)數(shu)據(ju)(ju)庫。

(六)不斷強化行政執法(fa)保障能(neng)力

1.加(jia)強(qiang)隊伍(wu)建(jian)(jian)設。根據(ju)行(xing)政(zheng)執(zhi)法(fa)機構所承擔(dan)的執(zhi)法(fa)職責(ze)和(he)工(gong)作任(ren)務,合理配備(bei)行(xing)政(zheng)執(zhi)法(fa)力量(liang)(liang),并注重行(xing)政(zheng)執(zhi)法(fa)機構隊伍(wu)梯隊建(jian)(jian)設。加(jia)強(qiang)行(xing)政(zheng)執(zhi)法(fa)機構公職律(lv)師和(he)法(fa)律(lv)顧問(wen)隊伍(wu)建(jian)(jian)設。整合有(you)關行(xing)政(zheng)執(zhi)法(fa)機關的法(fa)制(zhi)(zhi)審核力量(liang)(liang),建(jian)(jian)立重大執(zhi)法(fa)決定法(fa)制(zhi)(zhi)審核協作機制(zhi)(zhi)。

2.強化(hua)權益保(bao)障(zhang)。建立(li)健全行(xing)政(zheng)執法(fa)責(ze)任追(zhui)究(jiu)、盡職免予問責(ze)機制,細化(hua)追(zhui)責(ze)、免予問責(ze)情形和(he)容(rong)錯糾錯程序(xu)。落(luo)實和(he)完善行(xing)政(zheng)執法(fa)人員(yuan)工資待(dai)遇政(zheng)策,強化(hua)行(xing)政(zheng)執法(fa)人員(yuan)職業保(bao)障(zhang),依法(fa)為基層一線行(xing)政(zheng)執法(fa)人員(yuan)辦(ban)理保(bao)險(xian)。完善行(xing)政(zheng)執法(fa)人員(yuan)心理咨詢服務和(he)危機干預機制。

3.加大財政(zheng)支(zhi)持力(li)度。要按照(zhao)中央與地(di)方財政(zheng)事權和(he)支(zhi)出責任劃分原則,將行(xing)(xing)政(zheng)執(zhi)法(fa)工(gong)(gong)作(zuo)經費(fei)、行(xing)(xing)政(zheng)執(zhi)法(fa)裝備(bei)配備(bei)費(fei)用(yong)納入本級預算。結合(he)當(dang)地(di)財政(zheng)實際,合(he)理保障(zhang)行(xing)(xing)政(zheng)執(zhi)法(fa)經費(fei)投入力(li)度,切(qie)實滿(man)足行(xing)(xing)政(zheng)執(zhi)法(fa)工(gong)(gong)作(zuo)需要。

三(san)、組(zu)織實施

(一)加強組織領(ling)導(dao)。各地(di)區、各部門要(yao)切實加強(qiang)本計劃(hua)的組(zu)(zu)織(zhi)實施,將本計劃(hua)組(zu)(zu)織(zhi)實施情(qing)況及(ji)時向本級黨委(黨組(zu)(zu))報告。縣級以上地(di)方人(ren)民政府要(yao)建立司法(fa)行政、發展改革、財政、人(ren)力資源社會(hui)保障、政務服務管理、大數據管理以及(ji)其他有關行政執(zhi)法(fa)部門參加的工(gong)作會(hui)商機制,加強(qiang)對(dui)本計劃(hua)落實的統籌協調和督促(cu)指導(dao),及(ji)時研究解決本計劃(hua)實施過程中的共性問題。

(二)強化督(du)促(cu)落實。各地區、各部門(men)要(yao)明確任務分(fen)工,壓緊壓實責任,將貫徹落實本計(ji)劃情況納(na)入法(fa)治政(zheng)府(fu)建設督察、依法(fa)行政(zheng)考(kao)核(he)(he)內容,作(zuo)為對地方政(zheng)府(fu)、政(zheng)府(fu)部門(men)及(ji)其領導(dao)干部綜合績效考(kao)核(he)(he)的參考(kao)。適時組織開展(zhan)行政(zheng)執(zhi)法(fa)人民(min)群眾(zhong)滿意度第三(san)方測評(ping)。

(三)推進(jin)經(jing)驗(yan)交(jiao)流。各(ge)地區、各(ge)部門要(yao)充分利用報刊、廣(guang)播(bo)、電視等新(xin)聞媒體和網絡新(xin)媒體,廣(guang)泛宣傳提升行政執(zhi)法(fa)質量和效能的好(hao)(hao)舉措好(hao)(hao)經驗好(hao)(hao)做法(fa),注重(zhong)發(fa)現、培養和宣傳行政執(zhi)法(fa)先進人物、先進事跡,深入(ru)挖掘(jue)、總結推廣(guang)基層鮮活經驗,切實(shi)增強(qiang)行政執(zhi)法(fa)的權(quan)威(wei)性和公信力,在人民群(qun)眾(zhong)心中樹立良(liang)好(hao)(hao)執(zhi)法(fa)形象。

國務院(yuan)司(si)法(fa)行(xing)政部門要(yao)會同各有關(guan)方面(mian)加(jia)強(qiang)對本計劃(hua)實施情(qing)況(kuang)(kuang)的指導監督和(he)跟(gen)蹤(zong)分析(xi),組織(zhi)開展(zhan)實施情(qing)況(kuang)(kuang)評估,及時總結推廣典型(xing)經驗做法(fa),研究解決(jue)工作中(zhong)遇到(dao)的問題,重(zhong)要(yao)事項及時向黨中(zhong)央、國務院(yuan)報告。
