今年1月開始,全(quan)省開始執行《關于(yu)持續做好保障農民工(gong)(gong)工(gong)(gong)資支付工(gong)(gong)作的(de)通(tong)知》(以下簡稱(cheng)《通(tong)知》),全(quan)力維(wei)護農民工(gong)(gong)勞動報酬權益。省人社部門近日對《通(tong)知》內容(rong)進(jin)行了解讀。
《通知》要求,抓好工(gong)(gong)程項(xiang)(xiang)目(mu)(mu)欠(qian)薪(xin)源頭治本,嚴(yan)格(ge)落實“人(ren)盯(ding)(ding)人(ren)、人(ren)盯(ding)(ding)項(xiang)(xiang)目(mu)(mu)”網(wang)格(ge)協同監管(guan)責(ze)任制,落實農(nong)民工(gong)(gong)實名制和信息(xi)化平臺管(guan)理。嚴(yan)格(ge)落實農(nong)民工(gong)(gong)工(gong)(gong)資(zi)(zi)(zi)(zi)資(zi)(zi)(zi)(zi)金來(lai)源和專戶(hu)(hu)管(guan)理制度。各類(lei)工(gong)(gong)程項(xiang)(xiang)目(mu)(mu)建設單位(出資(zi)(zi)(zi)(zi)主體(ti))必須按約定足額向總(zong)承包(bao)企業農(nong)民工(gong)(gong)工(gong)(gong)資(zi)(zi)(zi)(zi)專用賬戶(hu)(hu)撥(bo)付人(ren)工(gong)(gong)費(fei)用。嚴(yan)格(ge)落實總(zong)承包(bao)企業代(dai)發工(gong)(gong)資(zi)(zi)(zi)(zi)和工(gong)(gong)資(zi)(zi)(zi)(zi)保(bao)(bao)證金制度。新建項(xiang)(xiang)目(mu)(mu)開工(gong)(gong)前(qian)施工(gong)(gong)總(zong)承包(bao)單位應在(zai)該項(xiang)(xiang)目(mu)(mu)農(nong)民工(gong)(gong)工(gong)(gong)資(zi)(zi)(zi)(zi)專用賬戶(hu)(hu)存儲(chu)農(nong)民工(gong)(gong)工(gong)(gong)資(zi)(zi)(zi)(zi)保(bao)(bao)證金,評為“無欠(qian)薪(xin)”企業、“無欠(qian)薪(xin)”項(xiang)(xiang)目(mu)(mu)的,免于存儲(chu)工(gong)(gong)資(zi)(zi)(zi)(zi)保(bao)(bao)證金。
  抓好欠薪案(an)(an)件動態清(qing)(qing)零銷號。一(yi)般性欠薪“三(san)日(ri)清(qing)(qing)零”,新發生(sheng)的(de)以(yi)及在建項目欠薪問(wen)(wen)題,力爭在三(san)日(ri)內核實清(qing)(qing)楚并清(qing)(qing)償到(dao)位(wei)。未(wei)及時解決(jue)欠薪問(wen)(wen)題的(de)將立(li)案(an)(an)嚴查。疑難(nan)復雜案(an)(an)件掛牌辦(ban)理。組(zu)織相(xiang)關部門(men)成(cheng)立(li)清(qing)(qing)欠專班,準確(que)核實實際欠薪人(ren)(ren)(ren)數和(he)金(jin)額。造(zao)成(cheng)不良社會影(ying)響的(de),采取約(yue)談(tan)措施,并對涉及單位(wei)項目從嚴從重處罰。用人(ren)(ren)(ren)單位(wei)發生(sheng)拖欠農民工工資違法行(xing)為,經責令改正(zheng)逾期仍不改正(zheng)的(de),對法定代(dai)表人(ren)(ren)(ren)、主要負責人(ren)(ren)(ren)和(he)直接負責的(de)主管人(ren)(ren)(ren)員處以(yi)罰款,依(yi)法向社會公布(bu),列入失(shi)信聯合懲戒(jie)對象(xiang)名單予以(yi)限(xian)制。
對(dui)欠(qian)薪線索發(fa)生數量、存量案件(jian)、政府工程和國有(you)企業欠(qian)薪、項(xiang)目(mu)(mu)管理運行(xing)(xing)等情況進行(xing)(xing)定期調度(du),清(qing)零(ling)情況和實(shi)際效果(guo)通過評估(gu)、回訪、督查后進行(xing)(xing)通報。將保障農民(min)工工資支付列為(wei)對(dui)各市、各有(you)關部門單位專項(xiang)目(mu)(mu)標(biao)責任考(kao)核(he)事(shi)項(xiang),全省打分排(pai)隊,按照優秀、良(liang)好、一般的(de)標(biao)準確(que)定考(kao)核(he)結果(guo),對(dui)考(kao)核(he)為(wei)一般的(de)市級政府負(fu)責人進行(xing)(xing)約談。
要重點(dian)解(jie)決農(nong)民(min)(min)工工資(zi)(zi)資(zi)(zi)金來源的欠(qian)薪(xin)根源性問題。明確(que)各(ge)類(lei)工程(cheng)項目建設單位(出資(zi)(zi)主體)必須(xu)按約定足(zu)(zu)額(e)向總承包企業(ye)農(nong)民(min)(min)工工資(zi)(zi)專(zhuan)戶撥(bo)付人工費用,撥(bo)付費用原則上不低(di)于工程(cheng)進度款的15%至(zhi)30%,撥(bo)付周期不能(neng)超過1個月,確(que)保專(zhuan)戶資(zi)(zi)金能(neng)夠(gou)保障按月足(zu)(zu)額(e)支(zhi)付工資(zi)(zi)。
