【基本案情】
2023年8月,徐某在上海青浦區某裝(zhuang)飾有限公司從事油漆工(gong)(gong)(gong)工(gong)(gong)(gong)作(zuo),雙方簽訂勞動合同,工(gong)(gong)(gong)程完工(gong)(gong)(gong)后未(wei)領(ling)取到(dao)工(gong)(gong)(gong)資款共(gong)計(ji)14400元,遂向“12351”工(gong)(gong)(gong)會(hui)服務職工(gong)(gong)(gong)熱線反(fan)映情(qing)況,希(xi)望工(gong)(gong)(gong)會(hui)介入幫助(zhu)其追(zhui)討(tao)被拖欠的工(gong)(gong)(gong)資。
【調解過程(cheng)】
上海市總(zong)工(gong)會(hui)第一(yi)時間指導青(qing)浦區總(zong)工(gong)會(hui)核實調處。經過青(qing)浦區總(zong)工(gong)會(hui)會(hui)同人社(she)等(deng)部門介入調處,責令企(qi)業(ye)方盡(jin)快支(zhi)付拖欠工(gong)資(zi),企(qi)業(ye)主(zhu)承諾2024年1月(yue)(yue)12日(ri)前一(yi)次性支(zhi)付拖欠工(gong)資(zi)。后又告知因財務外出無法按(an)照約(yue)定時間支(zhi)付欠薪款,承諾1月(yue)(yue)14日(ri)支(zhi)付。趙巷(xiang)鎮總(zong)工(gong)會(hui)及時與徐某進行(xing)溝(gou)通,說明了公司未按(an)約(yue)定時間支(zhi)付欠薪的客觀原(yuan)因,并告知再耐心等(deng)待至1月(yue)(yue)14日(ri),安撫(fu)職工(gong)情緒(xu)。
【調(diao)解結果】
1月15日下午(wu),在(zai)(zai)青浦區、趙巷鎮總工(gong)會(hui)的(de)現場督促下,企業支付了(le)其(qi)拖欠徐某工(gong)資14400元,趙某對討薪結果表(biao)示滿意,并感謝各級工(gong)會(hui)在(zai)(zai)調解(jie)過(guo)程中付出的(de)努力。
2.廣東省總工(gong)會(hui)推(tui)動解決某工(gong)業園四期項目工(gong)地(di)拖欠10名工(gong)人勞動報酬案件

常(chang)某(mou)(mou)(mou)(mou)(mou)某(mou)(mou)(mou)(mou)(mou)2023年10月開始在(zai)某(mou)(mou)(mou)(mou)(mou)工(gong)(gong)(gong)(gong)程局(ju)有限公司(si)總承包的某(mou)(mou)(mou)(mou)(mou)工(gong)(gong)(gong)(gong)業園四期項目(mu)(mu)工(gong)(gong)(gong)(gong)地工(gong)(gong)(gong)(gong)作,辦理了入職(zhi)手續,崗位(wei)是水暖工(gong)(gong)(gong)(gong),約定每天工(gong)(gong)(gong)(gong)資400元。帶班(ban)的包工(gong)(gong)(gong)(gong)頭曾某(mou)(mou)(mou)(mou)(mou)某(mou)(mou)(mou)(mou)(mou)在(zai)項目(mu)(mu)整(zheng)體還沒(mei)完工(gong)(gong)(gong)(gong)時,讓(rang)常(chang)某(mou)(mou)(mou)(mou)(mou)某(mou)(mou)(mou)(mou)(mou)等(deng)10名(ming)(ming)工(gong)(gong)(gong)(gong)人(ren)離職(zhi)回家(jia),勞(lao)動(dong)報酬沒(mei)有結清,包工(gong)(gong)(gong)(gong)頭曾某(mou)(mou)(mou)(mou)(mou)某(mou)(mou)(mou)(mou)(mou)打了欠(qian)條(tiao),合(he)計拖欠(qian)常(chang)某(mou)(mou)(mou)(mou)(mou)某(mou)(mou)(mou)(mou)(mou)等(deng)10名(ming)(ming)工(gong)(gong)(gong)(gong)人(ren)勞(lao)動(dong)報酬約22萬元。常(chang)某(mou)(mou)(mou)(mou)(mou)某(mou)(mou)(mou)(mou)(mou)等(deng)多次詢(xun)問(wen)項目(mu)(mu)部追討(tao)勞(lao)動(dong)報酬,一直沒(mei)有進(jin)展。常(chang)某(mou)(mou)(mou)(mou)(mou)某(mou)(mou)(mou)(mou)(mou)通(tong)過“12351”工(gong)(gong)(gong)(gong)會服務職(zhi)工(gong)(gong)(gong)(gong)熱線(xian)向工(gong)(gong)(gong)(gong)會投訴公司(si)拖欠(qian)勞(lao)動(dong)報酬,希(xi)望工(gong)(gong)(gong)(gong)會介(jie)入協調、跟進(jin)處理,協助職(zhi)工(gong)(gong)(gong)(gong)追討(tao)被拖欠(qian)的勞(lao)動(dong)報酬。
【調(diao)解過程】
深圳(zhen)市總工(gong)(gong)會工(gong)(gong)作人(ren)員主動跟(gen)常某某取得聯(lian)系(xi)(xi),并第一(yi)時間聯(lian)系(xi)(xi)該(gai)項目負(fu)責人(ren)劉某,與(yu)其溝通并了(le)解欠(qian)薪事(shi)件的起因經過,經協商,負(fu)責人(ren)馬上讓(rang)施(shi)工(gong)(gong)單位付款給勞務分包,并對勞務分包及時支付拖欠(qian)工(gong)(gong)人(ren)工(gong)(gong)資提(ti)出要求(qiu)。
【調解結果】
目前,該案件已(yi)(yi)得到處理。1月(yue)5號下(xia)午工資款已(yi)(yi)打到10名工人的賬(zhang)戶(hu)上(shang),合計約22萬元,拖欠(qian)的勞動報酬全部(bu)結(jie)清。
3.山東省(sheng)菏澤市(shi)總工(gong)會推動(dong)解決某食品有限公司拖欠職工(gong)勞動(dong)報(bao)酬案(an)件
【基本案(an)情(qing)】
2023年(nian)11月(yue),蘇(su)某(mou)(mou)某(mou)(mou)入(ru)職(zhi)菏澤某(mou)(mou)食(shi)品有(you)限公(gong)(gong)司(si),從事(shi)甜品烘焙師(shi)一(yi)職(zhi),當時(shi)雙方口頭約定(ding)每(mei)月(yue)底薪(xin)為2400元(yuan)(yuan),另加200元(yuan)(yuan)全勤工(gong)(gong)資。2024年(nian)1月(yue),公(gong)(gong)司(si)將(jiang)其工(gong)(gong)作崗(gang)位由(you)烘焙師(shi)調整為銷售前臺。工(gong)(gong)作一(yi)周后,蘇(su)某(mou)(mou)某(mou)(mou)表(biao)示不適應新工(gong)(gong)作崗(gang)位后辭職(zhi)。離(li)職(zhi)后,雙方對工(gong)(gong)資結算數額(e)產生爭議(yi)。公(gong)(gong)司(si)負責人蔡經理表(biao)示,口頭約定(ding)的是每(mei)月(yue)工(gong)(gong)資底薪(xin)2200元(yuan)(yuan),不存(cun)在底薪(xin)2400元(yuan)(yuan)一(yi)事(shi)。2024年(nian)1月(yue)15日(ri),蘇(su)某(mou)(mou)某(mou)(mou)向(xiang)“12351”工(gong)(gong)會服務職(zhi)工(gong)(gong)熱線求助,希望工(gong)(gong)會幫助解決(jue)。
【調解(jie)過程】
魯西新區(qu)總工會接到轉辦案件后,迅(xun)速聯系蘇某某和菏澤某食品(pin)有限公司了(le)解情(qing)況(kuang)。因并未簽訂(ding)勞動合(he)同,雙方無法提供任何關于約(yue)定薪資(zi)水平的證據。
魯(lu)西新區總(zong)工(gong)(gong)(gong)會(hui)(hui)勞動(dong)(dong)(dong)爭議(yi)調解員告知(zhi)(zhi)蔡經(jing)理(li),不與職工(gong)(gong)(gong)簽(qian)訂(ding)勞動(dong)(dong)(dong)合同(tong)屬于(yu)違法行為(wei),不論此次案件是(shi)否(fou)(fou)調解成功、能否(fou)(fou)達成一致意(yi)(yi)見(jian),上述(shu)行為(wei)都要進行整(zheng)改。經(jing)不懈努(nu)力,蔡經(jing)理(li)認識到了(le)公司自身的(de)問題,表(biao)示會(hui)(hui)立即進行整(zheng)改,與職工(gong)(gong)(gong)簽(qian)訂(ding)勞動(dong)(dong)(dong)合同(tong),明確工(gong)(gong)(gong)資標準等事項(xiang)。同(tong)時,調解員告知(zhi)(zhi)蘇某(mou)某(mou),在(zai)工(gong)(gong)(gong)作中要注意(yi)(yi)保存(cun)相關證據,主動(dong)(dong)(dong)要求簽(qian)訂(ding)勞動(dong)(dong)(dong)合同(tong)、明確工(gong)(gong)(gong)資標準,增強法律意(yi)(yi)識等。
【調解結果】
最后,雙方在工會(hui)調(diao)解(jie)下達(da)成一致(zhi)意見(jian),公(gong)司將按(an)照每月(yue)2400元底薪支(zhi)付(fu)蘇某某工資(zi)。2024年1月(yue)18日,魯西新區總工會(hui)對案件進行回(hui)訪,蘇某某表(biao)示工資(zi)已經支(zhi)付(fu)完畢(bi),十分(fen)感謝工會(hui)的(de)幫助。
4.四川(chuan)省(sheng)阿壩州總工會推動(dong)解決馬爾康市某酒店(dian)拖欠職工勞動(dong)報酬案件(jian)
【基本案(an)情】
馬(ma)爾康市(shi)某酒(jiu)店現有職(zhi)(zhi)工(gong)55人,基(ji)層(ceng)職(zhi)(zhi)工(gong)平(ping)均工(gong)資4000左右,近一(yi)個(ge)月內有十(shi)余人辭職(zhi)(zhi)。截至(zhi)2023年12月,基(ji)層(ceng)服務員(yuan)(職(zhi)(zhi)工(gong))已被欠薪(xin)4個(ge)月,后(hou)勤(辦公室(shi),財務室(shi)及(ji)管理層(ceng))人員(yuan)已被欠薪(xin)5個(ge)月。
【調(diao)解過程】
職(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)通過(guo)(guo)“12351”工(gong)(gong)(gong)(gong)(gong)(gong)會(hui)(hui)服務職(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)熱(re)線求助,希望(wang)工(gong)(gong)(gong)(gong)(gong)(gong)會(hui)(hui)幫助解(jie)決(jue)。阿壩州總(zong)(zong)(zong)工(gong)(gong)(gong)(gong)(gong)(gong)會(hui)(hui)黨(dang)組第一時(shi)間進行(xing)現場(chang)調查,詢問(wen)職(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)具(ju)體(ti)情況,經多(duo)方聯系核實(shi),確定(ding)欠薪情況屬實(shi)。隨(sui)后(hou),第一時(shi)間將欠薪情況告(gao)知馬爾(er)康市總(zong)(zong)(zong)工(gong)(gong)(gong)(gong)(gong)(gong)會(hui)(hui),并聯系酒(jiu)店(dian)負責人(ren)進行(xing)調解(jie),酒(jiu)店(dian)負責人(ren)承諾進行(xing)內部協調。阿壩州總(zong)(zong)(zong)工(gong)(gong)(gong)(gong)(gong)(gong)會(hui)(hui)督促馬爾(er)康市總(zong)(zong)(zong)工(gong)(gong)(gong)(gong)(gong)(gong)會(hui)(hui)實(shi)時(shi)跟進協調過(guo)(guo)程,并不定(ding)時(shi)打電話詢問(wen)基(ji)層職(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)爭議解(jie)決(jue)的情況。最后(hou)酒(jiu)店(dian)和職(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)雙方達成(cheng)一致,于每月稅款到賬日(ri)支付職(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)勞(lao)動報酬。
【調解結(jie)果】
截至目前,酒店已經為其基層(ceng)職(zhi)工發放50多萬元勞動報(bao)酬,職(zhi)工們非常感(gan)謝工會(hui)的(de)協調處理。
5.海南省陵(ling)水黎(li)族自治縣總工會調解(jie)陵(ling)水縣某(mou)村項目拖欠(qian)工人勞動報酬案件
【基本案情】
2023年(nian)10月18日,工(gong)人劉(liu)某(mou)致電“12351”工(gong)會服務(wu)職工(gong)熱線尋求(qiu)幫(bang)助。劉(liu)某(mou)2023年(nian)6月至(zhi)8月在海南省某(mou)有(you)限公司下屬(shu)海南省陵(ling)水縣(xian)某(mou)村項(xiang)目(mu)工(gong)作,主要工(gong)作內容為打釘、綁(bang)電線、開車等,并(bing)與項(xiang)目(mu)承(cheng)包(bao)商約(yue)定(ding)工(gong)資為12800元(yuan)。劉(liu)某(mou)訴稱(cheng)承(cheng)包(bao)商拖欠其勞動報酬一(yi)萬余元(yuan),經(jing)多次(ci)討要一(yi)直(zhi)未得到(dao)支付。
【調解過程】
陵水(shui)黎族自治縣總(zong)工(gong)會及(ji)時與劉(liu)某、承(cheng)包(bao)商取得聯系,核(he)實情(qing)況。經核(he)實了(le)解(jie)(jie)(jie),承(cheng)包(bao)商之所以(yi)拖欠其(qi)薪資,是因為(wei)(wei)劉(liu)某在工(gong)作過程中(zhong)損(sun)壞工(gong)作車(che),未(wei)支(zhi)(zhi)付(fu)的薪資抵作修(xiu)理(li)(li)費。劉(liu)某承(cheng)認(ren)損(sun)壞工(gong)作車(che)事實,但認(ren)為(wei)(wei)修(xiu)理(li)(li)費過高不合理(li)(li),雙方(fang)爭執(zhi)不下。2023年10月19日,縣總(zong)工(gong)會組織雙方(fang)進行(xing)現(xian)場調解(jie)(jie)(jie)。通過現(xian)場核(he)對工(gong)資支(zhi)(zhi)付(fu)清(qing)單,確定承(cheng)包(bao)商實際(ji)未(wei)支(zhi)(zhi)付(fu)勞(lao)動(dong)報(bao)酬為(wei)(wei)3000元,經協商,劉(liu)某同意(yi)支(zhi)(zhi)付(fu)車(che)輛修(xiu)理(li)(li)費用(yong),最終雙方(fang)達成(cheng)一致(zhi)意(yi)見,簽訂工(gong)資結算通知書,承(cheng)包(bao)商結清(qing)劉(liu)某工(gong)資余(yu)款2600元。自接受(shou)訴求到調解(jie)(jie)(jie)成(cheng)功(gong),縣總(zong)工(gong)會僅(jin)用(yong)兩(liang)天(tian)時間就解(jie)(jie)(jie)決(jue)了(le)農民工(gong)的討薪難題,成(cheng)功(gong)維(wei)護(hu)了(le)勞(lao)動(dong)者的合法權(quan)益。
【調解結果】
2023年10月20日(ri),在(zai)縣總工會的(de)監(jian)督下,承包(bao)商向(xiang)劉(liu)某微信轉賬(zhang)2600元。
6.廣西南寧市總工(gong)會推動(dong)解決某動(dong)物園外包建(jian)筑(zhu)項目拖(tuo)欠15名農民工(gong)勞動(dong)報酬案件
【基本案情】
2023年11月27日,曾(ceng)某致電“12351”工(gong)會服(fu)務職工(gong)熱線尋(xun)求南寧(ning)市工(gong)會幫(bang)助。曾(ceng)某訴稱2023年9月-10月在南寧(ning)市某動物園(yuan)從事外包(bao)建筑項(xiang)目裝(zhuang)網(wang)工(gong)作,班組內(nei)15名(ming)農(nong)民工(gong)共被拖欠9萬余元勞動報酬。

二、工會聯合政府相關部門推動解(jie)決
7.兵團(tuan)第十三師新(xin)星市總(zong)工會聯合勞(lao)動監察(cha)部門協助貨(huo)車司機追討勞(lao)動報酬案件(jian)
【基本案情】
信訪人(ren)朱(zhu)某是中(zhong)鐵某國際物流有(you)限(xian)公司的一(yi)名貨車(che)司機,于2023年(nian)8月(yue)下(xia)旬(xun)離(li)職(zhi),離(li)職(zhi)之后多次(ci)向(xiang)原(yuan)單(dan)位(wei)索要(yao)勞動(dong)報酬,單(dan)位(wei)一(yi)直以各(ge)種理由推脫(tuo),該(gai)單(dan)位(wei)共拖欠朱(zhu)某及(ji)其10名工友15萬余元的勞動(dong)報酬。2023年(nian)10月(yue)10日,朱(zhu)某撥打“12351”工會(hui)(hui)服務職(zhi)工熱線(xian),希(xi)望工會(hui)(hui)可(ke)以幫助他們向(xiang)中(zhong)鐵某國際物流有(you)限(xian)公司索要(yao)自己的勞動(dong)報酬。
【處理(li)過程】
2023年10月10日(ri),第(di)十三師新星市(shi)總(zong)工會(hui)(hui)第(di)一時間安(an)排專人(ren)負責(ze)跟(gen)進了(le)解詳(xiang)(xiang)細情況(kuang)(kuang),分別與(yu)朱某及該單位負責(ze)人(ren)取得聯系,詳(xiang)(xiang)細了(le)解具體情況(kuang)(kuang)。10月17日(ri),師市(shi)總(zong)工會(hui)(hui)與(yu)勞(lao)(lao)(lao)動(dong)監察支隊前(qian)往該欠薪企(qi)(qi)業(ye)進行實地走訪,與(yu)企(qi)(qi)業(ye)負責(ze)人(ren)當(dang)面(mian)核實欠薪事(shi)項(xiang)。由于(yu)(yu)物流行業(ye)的(de)(de)特殊性,無(wu)法(fa)(fa)確認勞(lao)(lao)(lao)動(dong)用工所在地,十三師只是其(qi)休(xiu)息中轉點,按照(zhao)勞(lao)(lao)(lao)動(dong)監察的(de)(de)區(qu)域受理(li)原則,此次欠薪事(shi)件并不屬于(yu)(yu)師市(shi)的(de)(de)受理(li)范圍(wei)。面(mian)對此情形,師市(shi)總(zong)工會(hui)(hui)工作人(ren)員要求該企(qi)(qi)業(ye)提(ti)供朱某等10人(ren)的(de)(de)勞(lao)(lao)(lao)動(dong)合(he)同,以(yi)確定勞(lao)(lao)(lao)動(dong)用工所在地。該企(qi)(qi)業(ye)人(ren)事(shi)表示并未(wei)找到朱某等人(ren)的(de)(de)勞(lao)(lao)(lao)動(dong)合(he)同,當(dang)初入職(zhi)并未(wei)按照(zhao)要求簽訂勞(lao)(lao)(lao)動(dong)合(he)同。于(yu)(yu)是,工作人(ren)員為其(qi)詳(xiang)(xiang)細講(jiang)解了(le)《勞(lao)(lao)(lao)動(dong)法(fa)(fa)》的(de)(de)相關規(gui)定,該企(qi)(qi)業(ye)負責(ze)人(ren)也當(dang)場表示會(hui)(hui)在當(dang)天下(xia)午將10人(ren)勞(lao)(lao)(lao)動(dong)報酬全部發放到位。

2023年10月(yue)18日,工作人員聯系朱某(mou),對方表示已經收(shou)到(dao)勞動報酬(chou),并稱贊新疆(jiang)兵團的工作作風和(he)辦事效(xiao)率。同時,朱某(mou)表示其(qi)余司機(ji)也收(shou)到(dao)了勞動報酬(chou),他們10人共計15萬多的勞動報酬(chou)均已收(shou)到(dao)。
8.江蘇(su)省(sheng)沛縣總工(gong)會聯(lian)合(he)人社部門推動解(jie)決江蘇(su)某新能源(yuan)有限公司拖欠農民工(gong)勞動報酬(chou)案件
【基本案情】
江蘇沛縣總工會通過抖音平臺發現該縣江蘇某新能源(yuan)有限公司(si)拖欠(qian)農民工2023年12月勞動報酬問題(ti)。經核實,該公司(si)承認拖欠(qian)勞動報酬情況屬(shu)實,拖欠(qian)勞動報酬是(shi)由于企業停產造成的。
【處理過程】

2022年(nian)初,某航空食(shi)品公司(si)業務大幅度(du)下滑,2022年(nian)9月(yue)公司(si)以客(ke)觀(guan)情(qing)況發生重大變(bian)化為由(you)向全體職工(gong)下發了(le)解(jie)除勞動關(guan)系通知(zhi)書(shu),但是對解(jie)除勞動關(guan)系經濟補償金只字不提,2022年(nian)1月(yue)后工(gong)資未支(zhi)付。
【處理過程】

外(wai)來務工(gong)人(ren)員劉(liu)某于2023年(nian)9月至(zhi)(zhi)2023年(nian)11月4日(ri)期間,受山東某安(an)裝(zhuang)工(gong)程(cheng)有限公(gong)(gong)司(si)(以下簡稱“安(an)裝(zhuang)工(gong)程(cheng)公(gong)(gong)司(si)”,駐(zhu)地在濰(wei)坊壽(shou)光(guang)市(shi)(shi))雇傭,在濟(ji)南市(shi)(shi)萊蕪(wu)區某項目從(cong)事電(dian)焊工(gong)作(zuo),未簽訂(ding)勞(lao)動合同(tong),約(yue)定勞(lao)動報(bao)酬每日(ri)400元(yuan),由安(an)裝(zhuang)工(gong)程(cheng)公(gong)(gong)司(si)通(tong)過(guo)(guo)銀行轉賬形式發放(fang)。因被拖(tuo)欠2023年(nian)10月至(zhi)(zhi)11月4日(ri)的(de)勞(lao)動報(bao)酬11325元(yuan),劉(liu)某通(tong)過(guo)(guo)多種途徑反映(ying)問題,均未得(de)到解決。2024年(nian)1月,劉(liu)某通(tong)過(guo)(guo)“12351”工(gong)會服(fu)務職工(gong)熱線求助壽(shou)光(guang)市(shi)(shi)總工(gong)會,希望幫(bang)助自(zi)己和另外(wai)3名農民(min)工(gong)討回被拖(tuo)欠的(de)勞(lao)動報(bao)酬。

在壽光市(shi)總工(gong)(gong)(gong)會和相關(guan)部(bu)門的緊(jin)密配合下(xia),安裝工(gong)(gong)(gong)程公司于2024年1月8日將拖欠的全部(bu)工(gong)(gong)(gong)資支付(fu)給(gei)了劉某等4名(ming)農民(min)工(gong)(gong)(gong)。劉某等4名(ming)農民(min)工(gong)(gong)(gong)對工(gong)(gong)(gong)會工(gong)(gong)(gong)作(zuo)表(biao)示滿意。
12.陜西(xi)省總(zong)工(gong)會(hui)提(ti)供法律援助幫助農民工(gong)討薪
【基本案情】
吳某等4名(ming)農(nong)民工(gong)曾是西(xi)安(an)市某工(gong)程項目(mu)的(de)勞(lao)(lao)務人員(yuan),2021年3月至2022年1月期間的(de)部分工(gong)資報酬(chou)至今未兌現,欠賬總(zong)(zong)數達14.5萬余元。為此,他們向當地勞(lao)(lao)動監察(cha)大隊(dui)投訴,但責任單位(wei)以上級單位(wei)拖欠工(gong)程款為由進行推(tui)脫(tuo)。為幫(bang)助農(nong)民工(gong)討薪(xin),陜(shan)西(xi)省總(zong)(zong)工(gong)會在(zai)2023年5月受理后,立即決定(ding)提(ti)供律師(shi)代理的(de)法律援助,幫(bang)助農(nong)民共通過訴訟程序依法維權。
【處理(li)過(guo)程】
陜西省總工(gong)(gong)(gong)會職(zhi)工(gong)(gong)(gong)幫(bang)扶服(fu)務(wu)中心經過分(fen)析研判,確定了直接(jie)通過人(ren)民法院民事訴訟追索勞務(wu)費(fei)的(de)維權思路,指(zhi)派(pai)勞動(dong)維權律師(shi)(shi)志愿者為他們合并代理。幫(bang)扶中心和律師(shi)(shi)指(zhi)導農民工(gong)(gong)(gong)收集證(zheng)據(ju),完成(cheng)代理案件(jian)的(de)相(xiang)關訴訟文(wen)書(shu)。面對詳實的(de)證(zheng)據(ju)材料以及律師(shi)(shi)的(de)據(ju)理力(li)爭,責任單位最終妥協,在一審庭審程序中達成(cheng)調解,承諾分(fen)期支(zhi)付拖欠農民工(gong)(gong)(gong)的(de)勞務(wu)費(fei)。

后期,責任(ren)單位在分期履(lv)行約(yue)定(ding)過(guo)程(cheng)中,未按調解書約(yue)定(ding)支付(fu)最(zui)后一期勞務費,農(nong)(nong)民工無(wu)奈(nai)再次向陜西省總(zong)工會求助(zhu)(zhu)。工會繼續(xu)為其(qi)提供法律援助(zhu)(zhu),指派(pai)律師幫助(zhu)(zhu)準備強制(zhi)執(zhi)行申請材料(liao),又指導他們向人民法院申請強制(zhi)執(zhi)行,促(cu)使責任(ren)單位全部支付(fu)了農(nong)(nong)民工工資,目前該案(an)件已(yi)經圓滿(man)結束。
