各市(shi)、縣人民(min)政(zheng)府,省人民(min)政(zheng)府各委、辦、廳、局:

為全面(mian)貫徹落(luo)實(shi)(shi)習近平(ping)總書記關于根(gen)治(zhi)欠薪(xin)重要(yao)指(zhi)示(shi)批示(shi)精(jing)神,落(luo)實(shi)(shi)省(sheng)委、省(sheng)政府(fu)工(gong)作部署,持續鞏(gong)固(gu)拓展我(wo)省(sheng)根(gen)治(zhi)欠薪(xin)工(gong)作成果,實(shi)(shi)現農民(min)(min)工(gong)工(gong)資基(ji)本(ben)無拖欠,根(gen)據《保障農民(min)(min)工(gong)工(gong)資支(zhi)付(fu)條(tiao)例》《山西省(sheng)保障農民(min)(min)工(gong)工(gong)資支(zhi)付(fu)辦法(fa)》等有關規定,經(jing)省(sheng)政府(fu)同(tong)意(yi),現就持續做(zuo)好保障農民(min)(min)工(gong)工(gong)資支(zhi)付(fu)工(gong)作通(tong)知如下(xia):

一、強(qiang)化巡查監(jian)管,抓好(hao)工程(cheng)項目欠薪源頭治本

(一)嚴格落實“人(ren)盯人(ren)、人(ren)盯項(xiang)目”網格協同監管責任制

市縣(xian)政(zheng)(zheng)府(fu)(fu)分(fen)管負責(ze)人(ren)是加強各自領域(yu)項(xiang)(xiang)(xiang)目(mu)監(jian)管、保(bao)(bao)障(zhang)工(gong)(gong)(gong)資(zi)支付(fu)第一責(ze)任人(ren),要牽頭(tou)會同(tong)省(sheng)、市、縣(xian)三級(ji)(ji)人(ren)力資(zi)源(yuan)社會保(bao)(bao)障(zhang)部門(men)(men)和(he)行(xing)業主(zhu)管部門(men)(men)網格責(ze)任人(ren)按項(xiang)(xiang)(xiang)目(mu)簽訂監(jian)管責(ze)任書,共同(tong)做好區域(yu)內(nei)工(gong)(gong)(gong)程項(xiang)(xiang)(xiang)目(mu)拖欠(qian)農民工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)問(wen)(wen)題的(de)預(yu)防化解工(gong)(gong)(gong)作。縣(xian)級(ji)(ji)政(zheng)(zheng)府(fu)(fu)負責(ze)人(ren)組織縣(xian)級(ji)(ji)各有(you)關部門(men)(men)在項(xiang)(xiang)(xiang)目(mu)開(kai)工(gong)(gong)(gong)農民工(gong)(gong)(gong)進場1個(ge)月(yue)內(nei)完(wan)成實(shi)(shi)地檢(jian)查(cha),督(du)(du)促(cu)將實(shi)(shi)名(ming)制、工(gong)(gong)(gong)資(zi)專戶、總包(bao)代發、工(gong)(gong)(gong)資(zi)保(bao)(bao)證(zheng)金、維(wei)權公示、工(gong)(gong)(gong)程款(kuan)支付(fu)擔保(bao)(bao)、施(shi)工(gong)(gong)(gong)過程結算(suan)等制度規范落實(shi)(shi)到位。市級(ji)(ji)相(xiang)關部門(men)(men)負責(ze)監(jian)督(du)(du)縣(xian)級(ji)(ji)履職情(qing)況和(he)項(xiang)(xiang)(xiang)目(mu)制度運(yun)行(xing)情(qing)況,督(du)(du)促(cu)依法實(shi)(shi)施(shi)行(xing)政(zheng)(zheng)處(chu)(chu)罰(fa),提級(ji)(ji)查(cha)處(chu)(chu)重大違法事項(xiang)(xiang)(xiang)。省(sheng)級(ji)(ji)相(xiang)關部門(men)(men)開(kai)展督(du)(du)查(cha)督(du)(du)辦、實(shi)(shi)施(shi)約談問(wen)(wen)責(ze)。

人力資源社會保障部門重點對(dui)在(zai)建(jian)工(gong)(gong)程項目(mu)和(he)相(xiang)關(guan)部門預防(fang)處置欠(qian)薪(xin)問題進行組織(zhi)協調(diao)、管理(li)指導、監督檢查和(he)考核評價;組織(zhi)開展工(gong)(gong)資支付法(fa)律法(fa)規普法(fa)宣傳,發放工(gong)(gong)程項目(mu)工(gong)(gong)資支付指導手冊(ce),制定勞動用工(gong)(gong)管理(li)操(cao)作規范,打造標準(zhun)化項目(mu)標桿,對(dui)全省(sheng)項目(mu)各參(can)建(jian)單位進行一體化、清單式的管理(li)服務。

住房城鄉建設、交通運(yun)輸(shu)、水利等(deng)(deng)領域行(xing)業主管部門規(gui)范(fan)項目(mu)施工(gong)(gong)秩(zhi)序,及時(shi)查處有關(guan)(guan)部門移送的拖欠工(gong)(gong)程款、違法轉分包、掛靠等(deng)(deng)違法線索(suo),督(du)辦(ban)解(jie)決由(you)此引發的欠薪問題;建立健全本(ben)行(xing)業內工(gong)(gong)程項目(mu)關(guan)(guan)于(yu)工(gong)(gong)程量、工(gong)(gong)程質(zhi)量、工(gong)(gong)程造價(jia)、價(jia)款結(jie)算等(deng)(deng)方面(mian)糾(jiu)紛爭(zheng)議(yi)的協(xie)調(diao)解(jie)決機制,并廣泛公布相關(guan)(guan)訴求反映途(tu)徑,推(tui)動矛盾糾(jiu)紛多元化化解(jie),調(diao)解(jie)不成(cheng)的妥善(shan)引導通過司法等(deng)(deng)途(tu)徑解(jie)決,監(jian)督(du)有關(guan)(guan)參建單(dan)位不得因相關(guan)(guan)糾(jiu)紛爭(zheng)議(yi)欠付農(nong)民工(gong)(gong)工(gong)(gong)資(zi)。

審(shen)計機(ji)關(guan)加(jia)強對政(zheng)府機(ji)關(guan)、事業(ye)(ye)(ye)單位(wei)、國有企(qi)(qi)業(ye)(ye)(ye)投(tou)資建設項(xiang)目人工(gong)(gong)(gong)費用撥(bo)付等工(gong)(gong)(gong)資保(bao)障(zhang)重大政(zheng)策落實情況的(de)監督和稽查。工(gong)(gong)(gong)業(ye)(ye)(ye)和信息化、中小(xiao)企(qi)(qi)業(ye)(ye)(ye)主管部門核實處理機(ji)關(guan)、事業(ye)(ye)(ye)單位(wei)和大型國有企(qi)(qi)業(ye)(ye)(ye)拖欠民(min)營企(qi)(qi)業(ye)(ye)(ye)、中小(xiao)企(qi)(qi)業(ye)(ye)(ye)賬款問題,督促優先清償(chang)農民(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資。其他各(ge)有關(guan)部門單位(wei)共同(tong)做好本(ben)部門單位(wei)、本(ben)行(xing)業(ye)(ye)(ye)投(tou)資建設和監管工(gong)(gong)(gong)程項(xiang)目的(de)保(bao)障(zhang)農民(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資支付工(gong)(gong)(gong)作。

(二)嚴格落(luo)實農民工實名制和信(xin)息化平臺管理

各(ge)市政府應(ying)(ying)建立本地區(qu)農民工工資支付監(jian)(jian)控預(yu)警(jing)平臺(tai)(tai)(tai),將(jiang)本地區(qu)工程項(xiang)目(mu)全部(bu)(bu)納(na)入平臺(tai)(tai)(tai)管(guan)理,并與省(sheng)級(ji)平臺(tai)(tai)(tai)互(hu)聯互(hu)通。履(lv)行(xing)工程建設(she)領域項(xiang)目(mu)開工建設(she)手續(xu)審(shen)批辦理職責的(de)相(xiang)(xiang)關主管(guan)部(bu)(bu)門(men),負(fu)責督促項(xiang)目(mu)在(zai)立項(xiang)、辦理開工手續(xu)后(hou)在(zai)農民工工資監(jian)(jian)控預(yu)警(jing)平臺(tai)(tai)(tai)建檔(dang),并將(jiang)項(xiang)目(mu)信息通報(bao)人力(li)資源社會保障(zhang)部(bu)(bu)門(men)和(he)相(xiang)(xiang)關行(xing)業主管(guan)部(bu)(bu)門(men)。各(ge)級(ji)發展改(gai)革、行(xing)政審(shen)批、人力(li)資源社會保障(zhang)、住房城鄉(xiang)建設(she)、交(jiao)通運輸、水利、能(neng)源、市場監(jian)(jian)管(guan)、金(jin)(jin)融(rong)監(jian)(jian)管(guan)、稅務(wu)、市政等(deng)部(bu)(bu)門(men),水電燃氣供應(ying)(ying)、物業管(guan)理單位以(yi)及金(jin)(jin)融(rong)機構,應(ying)(ying)將(jiang)預(yu)警(jing)監(jian)(jian)控所需信息數據按要(yao)求接入平臺(tai)(tai)(tai)。

工(gong)(gong)程項目(mu)(mu)(mu)總承(cheng)包單位(wei)應主動(dong)在平(ping)臺(tai)(tai)建(jian)(jian)檔,在項目(mu)(mu)(mu)開工(gong)(gong)前配(pei)備(bei)閘機、電子圍欄、計算機等實(shi)(shi)現實(shi)(shi)名(ming)(ming)制(zhi)管(guan)理、工(gong)(gong)資支付(fu)(fu)信息(xi)化(hua)(hua)(hua)預(yu)警監控(kong)等必備(bei)的軟硬件設施設備(bei),按要(yao)(yao)求在相(xiang)關(guan)信息(xi)化(hua)(hua)(hua)平(ping)臺(tai)(tai)完成信息(xi)錄(lu)(lu)入、數據對接等工(gong)(gong)作。要(yao)(yao)按項目(mu)(mu)(mu)配(pei)備(bei)專職勞(lao)資專管(guan)員(yuan),接受(shou)人力資源(yuan)社會保(bao)障部(bu)門和(he)相(xiang)關(guan)行(xing)業(ye)主管(guan)部(bu)門管(guan)理,專門負責確保(bao)所(suo)有進場作業(ye)農(nong)民工(gong)(gong)依法簽訂勞(lao)動(dong)合同(tong)或用工(gong)(gong)協議并進行(xing)實(shi)(shi)名(ming)(ming)制(zhi)登(deng)記,為項目(mu)(mu)(mu)所(suo)有農(nong)民工(gong)(gong)建(jian)(jian)立動(dong)態臺(tai)(tai)賬,準(zhun)確掌握項目(mu)(mu)(mu)農(nong)民工(gong)(gong)、勞(lao)務隊長(chang)及班組長(chang)等人員(yuan)底數,核對農(nong)民工(gong)(gong)考勤(qin)情(qing)況,核清農(nong)民工(gong)(gong)工(gong)(gong)資數額等,監督填寫勞(lao)動(dong)計酬手冊,完整記錄(lu)(lu)、動(dong)態更新實(shi)(shi)名(ming)(ming)制(zhi)管(guan)理和(he)工(gong)(gong)資支付(fu)(fu)等信息(xi)并錄(lu)(lu)入至相(xiang)關(guan)信息(xi)化(hua)(hua)(hua)平(ping)臺(tai)(tai)等。項目(mu)(mu)(mu)建(jian)(jian)設單位(wei)應加強對總承(cheng)包單位(wei)實(shi)(shi)行(xing)勞(lao)動(dong)用工(gong)(gong)和(he)工(gong)(gong)資支付(fu)(fu)信息(xi)化(hua)(hua)(hua)管(guan)理的監督。

人力資(zi)源社會保障部(bu)門(men)和相(xiang)(xiang)關行(xing)(xing)(xing)業主(zhu)管部(bu)門(men)利用信息化平臺(tai),對(dui)建(jian)設資(zi)金、人工費用、農民(min)工考勤及工資(zi)支(zhi)付等信息進(jin)(jin)行(xing)(xing)(xing)比對(dui),對(dui)項目農民(min)工工資(zi)情況和工資(zi)支(zhi)付保障制(zhi)(zhi)度落實(shi)情況實(shi)施分類分級預警監控,及時核(he)處(chu)(chu)欠薪(xin)風險(xian)隱患,查處(chu)(chu)懲戒違法違規行(xing)(xing)(xing)為。對(dui)拒不納入相(xiang)(xiang)關平臺(tai)進(jin)(jin)行(xing)(xing)(xing)實(shi)名制(zhi)(zhi)管理的項目依法依規進(jin)(jin)行(xing)(xing)(xing)處(chu)(chu)理。

(三)嚴(yan)格落實(shi)農民工工資(zi)資(zi)金來源和專戶管理制度

工(gong)程(cheng)(cheng)(cheng)項(xiang)目(mu)建(jian)設(she)資(zi)金不(bu)落實(shi)的,不(bu)得開工(gong)建(jian)設(she)。嚴(yan)格落實(shi)工(gong)程(cheng)(cheng)(cheng)預付(fu)(fu)(fu)款(kuan)和施工(gong)過(guo)程(cheng)(cheng)(cheng)結算制度(du)。建(jian)設(she)單位(wei)必須依法(fa)向(xiang)總承(cheng)包企(qi)業(ye)(ye)提供工(gong)程(cheng)(cheng)(cheng)款(kuan)支(zhi)付(fu)(fu)(fu)擔保(bao),政府投資(zi)工(gong)程(cheng)(cheng)(cheng)項(xiang)目(mu)可憑財(cai)政等有關部(bu)門(men)出具的項(xiang)目(mu)資(zi)金落實(shi)證(zheng)明(ming)替代工(gong)程(cheng)(cheng)(cheng)款(kuan)支(zhi)付(fu)(fu)(fu)擔保(bao)函(han)件。各類工(gong)程(cheng)(cheng)(cheng)項(xiang)目(mu)建(jian)設(she)單位(wei)(出資(zi)主體)必須按(an)(an)約定足(zu)額(e)向(xiang)總承(cheng)包企(qi)業(ye)(ye)農(nong)民(min)工(gong)工(gong)資(zi)專戶(hu)撥付(fu)(fu)(fu)人工(gong)費用(yong),撥付(fu)(fu)(fu)費用(yong)原則上不(bu)低于(yu)工(gong)程(cheng)(cheng)(cheng)進(jin)度(du)款(kuan)的15%~30%,具體比例由省人社廳商相關行業(ye)(ye)主管(guan)部(bu)門(men)確(que)(que)定。撥付(fu)(fu)(fu)周(zhou)期不(bu)能超過(guo)1個(ge)月(yue),但可以提前撥付(fu)(fu)(fu),應始終確(que)(que)保(bao)專戶(hu)資(zi)金能夠保(bao)障按(an)(an)月(yue)足(zu)額(e)支(zhi)付(fu)(fu)(fu)農(nong)民(min)工(gong)工(gong)資(zi)。

未按規定(ding)(ding)落實上述資(zi)金管理規定(ding)(ding)的,由相關(guan)部門依(yi)法對建(jian)設單(dan)位實施處(chu)理處(chu)罰(fa),責令限期(qi)補足(zu)資(zi)金,引發欠(qian)薪的由建(jian)設單(dan)位依(yi)法依(yi)規墊付被拖欠(qian)工資(zi),同時嚴肅(su)追究相關(guan)單(dan)位和人員責任。

加(jia)強對(dui)房地產開發項(xiang)目(mu)預售(shou)資金監管,鼓勵(li)、支(zhi)持(chi)、引導(dao)項(xiang)目(mu)建設單位設立農民(min)(min)工(gong)工(gong)資專門賬(zhang)戶(hu)管理相應(ying)資金,對(dui)其項(xiang)目(mu)人工(gong)費用和農民(min)(min)工(gong)工(gong)資進(jin)行統籌保障。

(四)嚴格落實(shi)總承包企業代發(fa)工(gong)(gong)資和工(gong)(gong)資保證(zheng)金制度

施(shi)(shi)工(gong)(gong)(gong)(gong)(gong)總(zong)承(cheng)包單(dan)位(wei)應(ying)(ying)在(zai)項目開工(gong)(gong)(gong)(gong)(gong)前(qian)督促分包單(dan)位(wei)與其簽訂(ding)農民工(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)委托支(zhi)(zhi)付(fu)協議。施(shi)(shi)工(gong)(gong)(gong)(gong)(gong)過程中分包單(dan)位(wei)應(ying)(ying)嚴格考(kao)勤并(bing)如(ru)實(shi)記錄農民工(gong)(gong)(gong)(gong)(gong)實(shi)際工(gong)(gong)(gong)(gong)(gong)作(zuo)天(tian)數和工(gong)(gong)(gong)(gong)(gong)作(zuo)量,準(zhun)確核(he)定(ding)農民工(gong)(gong)(gong)(gong)(gong)勞動應(ying)(ying)得的(de)全部(bu)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)數額,由施(shi)(shi)工(gong)(gong)(gong)(gong)(gong)總(zong)承(cheng)包單(dan)位(wei)勞資(zi)(zi)專管員審核(he)簽字(zi)后通過農民工(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)專用賬戶全額代發。由于工(gong)(gong)(gong)(gong)(gong)作(zuo)成(cheng)果結算、驗收(shou)等原(yuan)因(yin)當月(yue)(yue)(yue)確實(shi)無(wu)法準(zhun)確核(he)定(ding)全部(bu)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)數額的(de),可按照(zhao)勞動合同約定(ding)先(xian)支(zhi)(zhi)付(fu)基本工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)與已(yi)核(he)定(ding)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)部(bu)分,待(dai)核(he)定(ding)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)應(ying)(ying)在(zai)次月(yue)(yue)(yue)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)清單(dan)中予以體現并(bing)完成(cheng)支(zhi)(zhi)付(fu),最長(chang)核(he)定(ding)支(zhi)(zhi)付(fu)周期不(bu)得超過3個月(yue)(yue)(yue)或者農民工(gong)(gong)(gong)(gong)(gong)離場后1個月(yue)(yue)(yue)。

實(shi)行勞(lao)動(dong)計酬手冊(ce)制度,施工(gong)總承包(bao)單(dan)(dan)位(wei)應(ying)組織班組長(chang)、勞(lao)務隊長(chang)、分包(bao)單(dan)(dan)位(wei)及勞(lao)資(zi)專管員按月(yue)準確記錄農民工(gong)實(shi)際工(gong)作量、考勤、基本(ben)工(gong)資(zi)及績效工(gong)資(zi)核(he)定發放等情(qing)況,簽(qian)章后必須交由農民工(gong)本(ben)人簽(qian)字(zi)確認并(bing)妥善保存(cun),作為核(he)查處置(zhi)欠薪糾(jiu)紛(fen)的重(zhong)要依據。總承包(bao)單(dan)(dan)位(wei)留(liu)存(cun)的書面(mian)工(gong)資(zi)支付臺賬須與計酬手冊(ce)相關內容(rong)一(yi)致。

(五)嚴格落實維權公示(shi)和欠薪(xin)糾紛(fen)內(nei)部化解責任制

項(xiang)(xiang)目(mu)建(jian)設(she)單位應(ying)組織建(jian)立項(xiang)(xiang)目(mu)內部欠薪(xin)調(diao)處機構并在醒目(mu)位置公(gong)示聯系方式(shi),負(fu)責(ze)牽頭排查解(jie)決項(xiang)(xiang)目(mu)內欠薪(xin)隱患和問題。總承包(bao)單位項(xiang)(xiang)目(mu)經(jing)理(li)和勞務負(fu)責(ze)人是項(xiang)(xiang)目(mu)解(jie)決欠薪(xin)問題直接(jie)責(ze)任人。維權公(gong)示信(xin)息進項(xiang)(xiang)目(mu)、進宿舍、進工棚,維權手冊做到項(xiang)(xiang)目(mu)施(shi)工農民工人手發放一冊,力爭欠薪(xin)投(tou)訴不出項(xiang)(xiang)目(mu)、化解(jie)在基層。多次發生欠薪(xin)的(de)項(xiang)(xiang)目(mu),依(yi)法依(yi)規進行處理(li),向社會曝光;對欠薪(xin)投(tou)訴舉報多發的(de)縣級政(zheng)府主要(yao)負(fu)責(ze)人進行約談。

適時啟(qi)動(dong)“無(wu)欠薪(xin)”企(qi)(qi)業(ye)(ye)(ye)、“無(wu)欠薪(xin)”項(xiang)目(mu)打造(zao)活動(dong)。對(dui)工(gong)(gong)資(zi)保障(zhang)制度落實(shi)(shi)到位(wei),建(jian)設(she)資(zi)金(jin)到位(wei)情況(kuang)良好(hao),人(ren)工(gong)(gong)費(fei)用(yong)撥付充足(zu),建(jian)設(she)單位(wei)承(cheng)諾快速兜底解決欠薪(xin)問題(ti),總承(cheng)包(bao)單位(wei)已納入農民(min)工(gong)(gong)工(gong)(gong)資(zi)支付監控預警(jing)平臺管(guan)理,農民(min)工(gong)(gong)嚴格管(guan)理、工(gong)(gong)資(zi)底清數明,涉薪(xin)糾紛能在1日內自行調處(chu)完畢的項(xiang)目(mu)和(he)企(qi)(qi)業(ye)(ye)(ye),可在作(zuo)出相應(ying)書面信用(yong)承(cheng)諾并由(you)省級和(he)市級人(ren)力資(zi)源社(she)會保障(zhang)部門組織核驗后予以(yi)公示,給(gei)予相應(ying)激勵措施。減輕(qing)守法誠信企(qi)(qi)業(ye)(ye)(ye)負擔,切實(shi)(shi)優化(hua)營(ying)商環境,不斷加(jia)大(da)正面宣傳引(yin)導和(he)政策支持力度,營(ying)造(zao)保障(zhang)農民(min)工(gong)(gong)工(gong)(gong)資(zi)支付的強大(da)聲(sheng)勢(shi)和(he)良好(hao)氛圍。

二、突出結果導(dao)向(xiang),抓好(hao)欠薪案(an)件動態清零銷號(hao)

(六)嚴格實行(xing)“三(san)日清零”工作(zuo)機制

新發生(sheng)的以(yi)及在建工程項目(mu)發生(sheng)的拖欠農民工工資(zi)問題(ti)及糾紛,由案發地(di)欠薪(xin)線索受理部門(men)當日受理、首問負責,在3日內(nei)核(he)實清楚并清償(chang)到位。

未按期解決(jue)的(de)案(an)件(jian),由案(an)發地縣級政府主(zhu)要負責(ze)(ze)人(ren)包(bao)案(an)負責(ze)(ze),同(tong)步(bu)責(ze)(ze)成(cheng)相(xiang)關(guan)部門對(dui)涉案(an)單位和項目立案(an)調查(cha),對(dui)拖(tuo)欠工(gong)(gong)資(zi)(zi)、不(bu)落實工(gong)(gong)資(zi)(zi)保(bao)障(zhang)制(zhi)度、違(wei)法轉分包(bao)等(deng)違(wei)法行為依法實施(shi)整(zheng)改處罰措施(shi)、責(ze)(ze)令(ling)項目停(ting)工(gong)(gong),情(qing)節嚴重的(de)限制(zhi)承接新工(gong)(gong)程、降低資(zi)(zi)質等(deng)級、吊銷(xiao)資(zi)(zi)質證書。

(七(qi))嚴查疑(yi)難復雜(za)案(an)件

欠薪陳(chen)案(an)(an)積案(an)(an)等(deng)疑難復雜案(an)(an)件由案(an)(an)發地縣級政府負責人包(bao)案(an)(an),組織相(xiang)關部門(men)成立(li)清欠專班,準確核實實際(ji)欠薪人數和金額、限期解決。

對(dui)欠薪案(an)件和(he)(he)涉(she)薪糾紛引發重復(fu)、越級赴省(sheng)進京上訪(fang),造(zao)成(cheng)不(bu)良(liang)社會影響的,由省(sheng)人(ren)社廳(ting)約談案(an)發地縣政府主要負責人(ren),對(dui)涉(she)及單(dan)位項(xiang)目(mu)一律立案(an)查處(chu)、從嚴從重處(chu)罰,同時嚴肅(su)追究案(an)件辦理人(ren)員(yuan)(yuan)和(he)(he)項(xiang)目(mu)監管人(ren)員(yuan)(yuan)責任。

(八)嚴懲欠薪違法違規行為

用人(ren)單位發生(sheng)拖欠農民工(gong)工(gong)資(zi)違法(fa)行(xing)為,經責令改正逾期(qi)仍(reng)不改正的,對(dui)法(fa)定代(dai)表人(ren)、主要負責人(ren)和(he)直接負責的主管人(ren)員處以(yi)罰款(kuan),依(yi)法(fa)向社會公布,符(fu)合條件的列入(ru)(ru)拖欠農民工(gong)工(gong)資(zi)失信聯合懲戒對(dui)象名單,在政府(fu)資(zi)金支持、政府(fu)采購(gou)、招投標、融資(zi)貸款(kuan)、市場準入(ru)(ru)、稅收優惠、評(ping)優評(ping)先、交通(tong)出行(xing)等方面依(yi)法(fa)依(yi)規予(yu)以(yi)限制。

涉及政府(fu)投資工程項(xiang)(xiang)目(mu)(mu)和國企項(xiang)(xiang)目(mu)(mu)欠薪的(de),對項(xiang)(xiang)目(mu)(mu)主管人(ren)員(yuan)、項(xiang)(xiang)目(mu)(mu)經(jing)理、直接(jie)責(ze)(ze)任(ren)人(ren)實施經(jing)濟處罰和追責(ze)(ze)問責(ze)(ze)。

對逃避工(gong)(gong)資(zi)(zi)支付義務,以討(tao)要工(gong)(gong)資(zi)(zi)名義討(tao)要工(gong)(gong)程(cheng)款的勞(lao)務公司、實(shi)際施工(gong)(gong)人依(yi)法處理(li),向社會(hui)曝光并實(shi)施信(xin)用懲(cheng)戒(jie)。

(九)嚴格落實重大案件通報制度

對上(shang)級(ji)交辦、批(pi)辦的重大(da)欠薪線索,由省(sheng)(sheng)人(ren)社(she)廳(ting)書面通知(zhi)市、縣(xian)政府(fu),抄送同級(ji)黨委,督促限(xian)時辦結。對沒有按時辦結或案結事未了的,省(sheng)(sheng)人(ren)社(she)廳(ting)約談(tan)涉(she)及市、縣(xian)政府(fu)主要負責(ze)人(ren)并全省(sheng)(sheng)通報,涉(she)嫌失(shi)職失(shi)責(ze)的人(ren)員移送有關部門追究(jiu)責(ze)任(ren)。

(十)強化根治欠薪行政司(si)法(fa)聯動

嚴格執(zhi)行根治欠(qian)薪(xin)行政(zheng)司法(fa)聯(lian)動(dong)工(gong)(gong)作(zuo)(zuo)機制。相關部(bu)門(men)查(cha)處欠(qian)薪(xin)案(an)件(jian)時(shi)發生用人(ren)(ren)(ren)單位(wei)拒不配(pei)合調查(cha)、清償(chang)責任主(zhu)體(ti)及(ji)(ji)相關當事人(ren)(ren)(ren)無法(fa)聯(lian)系的(de),以及(ji)(ji)欠(qian)薪(xin)問(wen)題反映人(ren)(ren)(ren)擾(rao)亂欠(qian)薪(xin)信訪接待場所秩序的(de),公(gong)(gong)安(an)機關應依法(fa)及(ji)(ji)時(shi)協(xie)助處理。涉(she)嫌(xian)拒不支(zhi)付(fu)勞動(dong)報(bao)(bao)酬(chou)犯(fan)罪的(de),人(ren)(ren)(ren)力資(zi)源(yuan)(yuan)社會保障(zhang)(zhang)部(bu)門(men)及(ji)(ji)時(shi)移(yi)送公(gong)(gong)安(an)機關依法(fa)查(cha)處,必要時(shi)可提請公(gong)(gong)安(an)機關先行介入。人(ren)(ren)(ren)力資(zi)源(yuan)(yuan)社會保障(zhang)(zhang)部(bu)門(men)作(zuo)(zuo)出(chu)責令(ling)支(zhi)付(fu)被拖(tuo)欠(qian)的(de)農民(min)工(gong)(gong)工(gong)(gong)資(zi)的(de)決定(ding),相關單位(wei)不支(zhi)付(fu)的(de),及(ji)(ji)時(shi)申(shen)(shen)請人(ren)(ren)(ren)民(min)法(fa)院依法(fa)采取強制措施保障(zhang)(zhang)農民(min)工(gong)(gong)工(gong)(gong)資(zi)執(zhi)行到位(wei)。向(xiang)公(gong)(gong)安(an)機關移(yi)送的(de)涉(she)嫌(xian)拒不支(zhi)付(fu)勞動(dong)報(bao)(bao)酬(chou)犯(fan)罪案(an)件(jian)以及(ji)(ji)向(xiang)人(ren)(ren)(ren)民(min)法(fa)院申(shen)(shen)請執(zhi)行的(de)拖(tuo)欠(qian)農民(min)工(gong)(gong)工(gong)(gong)資(zi)案(an)件(jian),人(ren)(ren)(ren)力資(zi)源(yuan)(yuan)社會保障(zhang)(zhang)部(bu)門(men)及(ji)(ji)時(shi)提請人(ren)(ren)(ren)民(min)檢察院進(jin)行監督。

三、嚴格考核通報,抓好欠薪治理(li)工作責任落實(shi)

(十(shi)一(yi))加強根治欠薪工(gong)作組(zu)織領(ling)導。各(ge)市縣政府(fu)、各(ge)有關部門單位(wei)要(yao)(yao)將(jiang)保障農民工(gong)工(gong)資支付工(gong)作持(chi)續列為重(zhong)要(yao)(yao)議事(shi)事(shi)項,主要(yao)(yao)負責人直接(jie)推動(dong),每季度聽取工(gong)作情況(kuang)匯報,研究解決(jue)重(zhong)大突出事(shi)項,參加根治欠薪聯合大接(jie)訪,包案解決(jue)重(zhong)大欠薪案件,深入(ru)項目一(yi)線調研推動(dong)工(gong)資支付保障制度落實。

(十二)加強工作調(diao)度和通報(bao)運用。各(ge)市每月(yue)向所轄縣級政府(fu)通報(bao)區域內欠(qian)薪線(xian)索發(fa)生數量、存(cun)量案件、政府(fu)工程和國有企業(ye)欠(qian)薪、項目管理(li)運行等情況。

(十(shi)三)加(jia)強專(zhuan)項目標(biao)責任考(kao)核

將保障(zhang)農民工工資支付列為(wei)對各市(shi)、各有關部門單位專項目(mu)標責任考(kao)核(he)(he)(he)事項,全省打分排隊,按照優(you)秀、良好、一(yi)(yi)般(ban)的標準確定考(kao)核(he)(he)(he)結果,全省通報(bao)并抄送省委組織部,對考(kao)核(he)(he)(he)為(wei)一(yi)(yi)般(ban)的市(shi)級政(zheng)府負責人進行約談。考(kao)核(he)(he)(he)選擇書(shu)面審核(he)(he)(he)、實(shi)地核(he)(he)(he)查、委托第三方評估、明察暗訪、案件回訪等(deng)方式開展。

各地、各部門要高(gao)度重視保(bao)(bao)障農(nong)民(min)工工資(zi)支(zhi)付(fu)工作,不松勁、不懈(xie)怠、不停步,拿出更(geng)多有針對性措施(shi),形成(cheng)根治欠薪問題的強大(da)合力,切實維護(hu)(hu)廣大(da)農(nong)民(min)工群體勞(lao)動報酬權益,確保(bao)(bao)人民(min)群眾(zhong)獲得感(gan)(gan)成(cheng)色更(geng)足、幸福感(gan)(gan)更(geng)可持續(xu)、安全感(gan)(gan)更(geng)有保(bao)(bao)障,為維護(hu)(hu)社會穩定、優化營商環(huan)境(jing)、推(tui)動山西(xi)高(gao)質量發展(zhan)奠定堅實基礎。
