本(ben)報(bao)訊 經省政府(fu)同意,《》(以下簡稱《規(gui)定(ding)》)自2024年(nian)1月1日起施(shi)行,以加(jia)強土(tu)地(di)征收(shou)管(guan)理,規(gui)范土(tu)地(di)征收(shou)行為,維護被(bei)征地(di)農村集體經濟組織(zhi)和被(bei)征地(di)農民合(he)法權益。
《規定》明確(que)的土地征(zheng)收程序包(bao)括:發布(bu)征(zheng)收土地預公告(gao)、土地現狀調查(cha)、被征(zheng)地農民(min)基本養老保險補(bu)貼調查(cha)、編(bian)制征(zheng)地補(bu)償安(an)置方案、征(zheng)地補(bu)償安(an)置公告(gao)、組織聽證、辦理補(bu)償登記、簽訂征(zheng)地補(bu)償安(an)置協(xie)議(yi)等十余項(xiang)。
其(qi)中,發(fa)(fa)布征(zheng)(zheng)收(shou)(shou)(shou)(shou)(shou)土(tu)(tu)(tu)地預(yu)公(gong)(gong)告環節,市、縣級政府(fu)確需征(zheng)(zheng)收(shou)(shou)(shou)(shou)(shou)土(tu)(tu)(tu)地,在(zai)擬(ni)(ni)征(zheng)(zheng)收(shou)(shou)(shou)(shou)(shou)土(tu)(tu)(tu)地所在(zai)的鄉鎮(街道)和村(社區(qu))、村民小(xiao)組范(fan)圍(wei)內(nei)(nei)發(fa)(fa)布征(zheng)(zheng)收(shou)(shou)(shou)(shou)(shou)土(tu)(tu)(tu)地預(yu)公(gong)(gong)告,預(yu)公(gong)(gong)告時間不少于10個(ge)工作日。征(zheng)(zheng)收(shou)(shou)(shou)(shou)(shou)土(tu)(tu)(tu)地預(yu)公(gong)(gong)告應當包(bao)含征(zheng)(zheng)收(shou)(shou)(shou)(shou)(shou)范(fan)圍(wei)、征(zheng)(zheng)收(shou)(shou)(shou)(shou)(shou)目(mu)的等內(nei)(nei)容(rong)。自擬(ni)(ni)征(zheng)(zheng)收(shou)(shou)(shou)(shou)(shou)土(tu)(tu)(tu)地預(yu)公(gong)(gong)告發(fa)(fa)布之日起,任(ren)何(he)單位(wei)和個(ge)人不得(de)在(zai)擬(ni)(ni)征(zheng)(zheng)收(shou)(shou)(shou)(shou)(shou)范(fan)圍(wei)內(nei)(nei)搶(qiang)栽搶(qiang)建;違(wei)反規定搶(qiang)栽搶(qiang)建的,對搶(qiang)栽搶(qiang)建部分(fen)不予補償。
簽(qian)訂征(zheng)地(di)補(bu)償(chang)安(an)置(zhi)協(xie)議(yi)(yi)環節,市、縣(xian)級政府組織有關部門與擬征(zheng)收土(tu)地(di)的所有權(quan)人(ren)(ren)、土(tu)地(di)承包經營權(quan)人(ren)(ren)、宅基地(di)使(shi)用權(quan)人(ren)(ren)、集(ji)體(ti)建(jian)設用地(di)使(shi)用權(quan)人(ren)(ren)等簽(qian)訂征(zheng)地(di)補(bu)償(chang)安(an)置(zhi)協(xie)議(yi)(yi)。與擬征(zheng)收土(tu)地(di)的使(shi)用權(quan)人(ren)(ren)簽(qian)訂的征(zheng)地(di)補(bu)償(chang)安(an)置(zhi)協(xie)議(yi)(yi)數不得低于應當簽(qian)訂協(xie)議(yi)(yi)數的90%。
實(shi)施土地(di)征(zheng)收環節(jie),市、縣級政府應(ying)在征(zheng)收土地(di)公告發(fa)布之日(ri)起90日(ri)內足額支付土地(di)補(bu)償(chang)費、安置補(bu)助費以(yi)及農(nong)村(cun)村(cun)民住宅、其他(ta)地(di)上附著物和青(qing)苗等補(bu)償(chang)費用,按我省有(you)關規定落實(shi)被征(zheng)地(di)農(nong)民社(she)會保障(zhang)補(bu)貼。
土地(di)交付后,相關權利(li)人應根據簽訂的補償安置協議(yi)履行相關義務,將其不動(dong)產(chan)權證書交回土地(di)征收部門,并配合申請不動(dong)產(chan)注銷或變(bian)更登記。 (何(he)寶國)
