  《市(shi)場(chang)(chang)準(zhun)入(ru)負面清單(2025年版(ban))》已經(jing)黨中央、國(guo)務院批(pi)準(zhun),自即日起印(yin)發(fa)實施(shi),請結合實際(ji)認真(zhen)貫徹落實。2022年3月12日發(fa)布(bu)的《市(shi)場(chang)(chang)準(zhun)入(ru)負面清單(2022年版(ban))》(發(fa)改體(ti)改規〔2022〕397號)同時廢止(zhi)。

編者(zhe)按:近(jin)日,經黨(dang)中央、國(guo)務院批準,國(guo)家發展改革(ge)(ge)委(wei)會同商(shang)務部(bu)、市場監管總局發布《》(以下簡稱(cheng)《清(qing)(qing)單(2025年版)》),清(qing)(qing)單事項數量由2022年版的(de)117項縮減至106項,市場準入(ru)限制進一步放寬,市場準入(ru)管理更(geng)加優化,市場準入(ru)制度建設取得(de)新的(de)重要成果(guo)。為使各(ge)方面準確把握有(you)關情(qing)況,國(guo)家發展改革(ge)(ge)委(wei)有(you)關負責人近(jin)日就《清(qing)(qing)單(2025年版)》回(hui)答記者(zhe)提問(wen),現予發布。

  問:請問什么是市場準入負面清單制度?這項制度有哪些核心要求?

  答:市場(chang)準(zhun)(zhun)入(ru)(ru)負(fu)面(mian)(mian)清(qing)(qing)單(dan)制(zhi)度(du),是指以(yi)清(qing)(qing)單(dan)形式將我國境內禁止和經(jing)政府(fu)許(xu)可(ke)才能夠(gou)投資經(jing)營的(de)(de)行業、領域、業務(wu)匯總列(lie)出(chu),各(ge)級政府(fu)依法采(cai)取(qu)相應(ying)管(guan)理措施的(de)(de)一(yi)系列(lie)制(zhi)度(du)安排。市場(chang)準(zhun)(zhun)入(ru)(ru)負(fu)面(mian)(mian)清(qing)(qing)單(dan)之外,各(ge)類經(jing)營主體皆可(ke)依法平(ping)等進入(ru)(ru)。建立和實(shi)(shi)行全(quan)國統(tong)一(yi)的(de)(de)市場(chang)準(zhun)(zhun)入(ru)(ru)負(fu)面(mian)(mian)清(qing)(qing)單(dan)制(zhi)度(du),是黨中(zhong)央(yang)、國務(wu)院作出(chu)的(de)(de)重(zhong)大決策部署(shu)。黨的(de)(de)十八屆三(san)中(zhong)全(quan)會首(shou)次提出(chu)“實(shi)(shi)行統(tong)一(yi)的(de)(de)市場(chang)準(zhun)(zhun)入(ru)(ru)制(zhi)度(du)”和“制(zhi)定負(fu)面(mian)(mian)清(qing)(qing)單(dan)”的(de)(de)部署(shu)要求,黨的(de)(de)十九大進一(yi)步提出(chu)“全(quan)面(mian)(mian)實(shi)(shi)施市場(chang)準(zhun)(zhun)入(ru)(ru)負(fu)面(mian)(mian)清(qing)(qing)單(dan)制(zhi)度(du)”。經(jing)黨中(zhong)央(yang)、國務(wu)院批準(zhun)(zhun),國家發展改革委(wei)、商務(wu)部于2018年印發首(shou)版市場(chang)準(zhun)(zhun)入(ru)(ru)負(fu)面(mian)(mian)清(qing)(qing)單(dan),這項制(zhi)度(du)在全(quan)國全(quan)面(mian)(mian)實(shi)(shi)施,我國市場(chang)準(zhun)(zhun)入(ru)(ru)管(guan)理理念和模式實(shi)(shi)現重(zhong)大轉變(bian),成為全(quan)球首(shou)個(ge)針對國內市場(chang)準(zhun)(zhun)入(ru)(ru)實(shi)(shi)行負(fu)面(mian)(mian)清(qing)(qing)單(dan)管(guan)理模式的(de)(de)主要經(jing)濟體。

  這(zhe)項制(zhi)度的(de)(de)核心要(yao)(yao)求體(ti)(ti)現在(zai)以下(xia)幾(ji)個方面(mian)(mian)(mian):一(yi)是(shi)全國(guo)統(tong)一(yi)。也就是(shi)實(shi)行(xing)(xing)(xing)市(shi)(shi)(shi)場(chang)(chang)準(zhun)(zhun)入(ru)(ru)(ru)(ru)(ru)(ru)(ru)(ru)“全國(guo)一(yi)張清(qing)單(dan)(dan)”管(guan)理(li)(li)模式,全面(mian)(mian)(mian)統(tong)一(yi)市(shi)(shi)(shi)場(chang)(chang)準(zhun)(zhun)入(ru)(ru)(ru)(ru)(ru)(ru)(ru)(ru)制(zhi)度規(gui)(gui)則。這(zhe)是(shi)支撐(cheng)全國(guo)統(tong)一(yi)大(da)市(shi)(shi)(shi)場(chang)(chang)建設(she)(she)(she)的(de)(de)重要(yao)(yao)基(ji)礎性(xing)(xing)制(zhi)度安排。具體(ti)(ti)來說,我(wo)國(guo)境(jing)內(nei)各(ge)(ge)(ge)(ge)類依(yi)法(fa)(fa)設(she)(she)(she)定(ding)的(de)(de)市(shi)(shi)(shi)場(chang)(chang)準(zhun)(zhun)入(ru)(ru)(ru)(ru)(ru)(ru)(ru)(ru)管(guan)理(li)(li)措施(shi),要(yao)(yao)全部(bu)(bu)列入(ru)(ru)(ru)(ru)(ru)(ru)(ru)(ru)全國(guo)統(tong)一(yi)的(de)(de)市(shi)(shi)(shi)場(chang)(chang)準(zhun)(zhun)入(ru)(ru)(ru)(ru)(ru)(ru)(ru)(ru)負(fu)(fu)面(mian)(mian)(mian)清(qing)單(dan)(dan);各(ge)(ge)(ge)(ge)類按要(yao)(yao)求編制(zhi)的(de)(de)全國(guo)層面(mian)(mian)(mian)準(zhun)(zhun)入(ru)(ru)(ru)(ru)(ru)(ru)(ru)(ru)類清(qing)單(dan)(dan)目錄,要(yao)(yao)全部(bu)(bu)納入(ru)(ru)(ru)(ru)(ru)(ru)(ru)(ru)市(shi)(shi)(shi)場(chang)(chang)準(zhun)(zhun)入(ru)(ru)(ru)(ru)(ru)(ru)(ru)(ru)負(fu)(fu)面(mian)(mian)(mian)清(qing)單(dan)(dan)管(guan)理(li)(li);各(ge)(ge)(ge)(ge)地(di)(di)區、各(ge)(ge)(ge)(ge)部(bu)(bu)門不得另行(xing)(xing)(xing)制(zhi)定(ding)市(shi)(shi)(shi)場(chang)(chang)準(zhun)(zhun)入(ru)(ru)(ru)(ru)(ru)(ru)(ru)(ru)性(xing)(xing)質(zhi)(zhi)的(de)(de)負(fu)(fu)面(mian)(mian)(mian)清(qing)單(dan)(dan),從(cong)(cong)而做到(dao)“一(yi)單(dan)(dan)盡列、單(dan)(dan)外無(wu)單(dan)(dan)”。二(er)是(shi)事(shi)(shi)權(quan)(quan)法(fa)(fa)定(ding)。列入(ru)(ru)(ru)(ru)(ru)(ru)(ru)(ru)市(shi)(shi)(shi)場(chang)(chang)準(zhun)(zhun)入(ru)(ru)(ru)(ru)(ru)(ru)(ru)(ru)負(fu)(fu)面(mian)(mian)(mian)清(qing)單(dan)(dan)的(de)(de)事(shi)(shi)項,均由法(fa)(fa)律(lv)、行(xing)(xing)(xing)政法(fa)(fa)規(gui)(gui)、國(guo)務院(yuan)決定(ding)、地(di)(di)方性(xing)(xing)法(fa)(fa)規(gui)(gui)等(deng)設(she)(she)(she)立,省、自(zi)治區、直轄市(shi)(shi)(shi)政府規(gui)(gui)章(zhang)可(ke)(ke)(ke)依(yi)法(fa)(fa)設(she)(she)(she)定(ding)臨時性(xing)(xing)市(shi)(shi)(shi)場(chang)(chang)準(zhun)(zhun)入(ru)(ru)(ru)(ru)(ru)(ru)(ru)(ru)管(guan)理(li)(li)措施(shi);經(jing)(jing)濟運行(xing)(xing)(xing)中面(mian)(mian)(mian)臨突發重大(da)風險(xian)的(de)(de),部(bu)(bu)門可(ke)(ke)(ke)采取臨時性(xing)(xing)市(shi)(shi)(shi)場(chang)(chang)準(zhun)(zhun)入(ru)(ru)(ru)(ru)(ru)(ru)(ru)(ru)管(guan)理(li)(li)措施(shi),但必(bi)須報黨中央(yang)、國(guo)務院(yuan)同(tong)意;部(bu)(bu)門規(gui)(gui)章(zhang)和各(ge)(ge)(ge)(ge)級(ji)政府規(gui)(gui)范(fan)性(xing)(xing)文件(jian)(jian)等(deng)不得違(wei)(wei)規(gui)(gui)設(she)(she)(she)立市(shi)(shi)(shi)場(chang)(chang)準(zhun)(zhun)入(ru)(ru)(ru)(ru)(ru)(ru)(ru)(ru)管(guan)理(li)(li)措施(shi),從(cong)(cong)而確保(bao)市(shi)(shi)(shi)場(chang)(chang)準(zhun)(zhun)入(ru)(ru)(ru)(ru)(ru)(ru)(ru)(ru)制(zhi)度在(zai)法(fa)(fa)治原則下(xia)運行(xing)(xing)(xing)。三是(shi)公開透明。市(shi)(shi)(shi)場(chang)(chang)準(zhun)(zhun)入(ru)(ru)(ru)(ru)(ru)(ru)(ru)(ru)負(fu)(fu)面(mian)(mian)(mian)清(qing)單(dan)(dan)事(shi)(shi)項內(nei)容、主(zhu)(zhu)管(guan)部(bu)(bu)門等(deng)向社會全面(mian)(mian)(mian)公開。對于涉及(ji)市(shi)(shi)(shi)場(chang)(chang)準(zhun)(zhun)入(ru)(ru)(ru)(ru)(ru)(ru)(ru)(ru)行(xing)(xing)(xing)政許可(ke)(ke)(ke)的(de)(de)事(shi)(shi)項,地(di)(di)方各(ge)(ge)(ge)(ge)級(ji)政府還要(yao)(yao)公開法(fa)(fa)律(lv)法(fa)(fa)規(gui)(gui)依(yi)據(ju)、技術標準(zhun)(zhun)、許可(ke)(ke)(ke)要(yao)(yao)求、辦理(li)(li)流程、辦理(li)(li)時限(xian),確保(bao)經(jing)(jing)營主(zhu)(zhu)體(ti)(ti)可(ke)(ke)(ke)以按照規(gui)(gui)定(ding)的(de)(de)條件(jian)(jian)和方式合規(gui)(gui)進(jin)入(ru)(ru)(ru)(ru)(ru)(ru)(ru)(ru),從(cong)(cong)而形成穩定(ding)、透明、可(ke)(ke)(ke)預(yu)期的(de)(de)制(zhi)度安排,保(bao)障公眾的(de)(de)知(zhi)情(qing)權(quan)(quan)。四是(shi)“非(fei)禁即入(ru)(ru)(ru)(ru)(ru)(ru)(ru)(ru)”。市(shi)(shi)(shi)場(chang)(chang)準(zhun)(zhun)入(ru)(ru)(ru)(ru)(ru)(ru)(ru)(ru)負(fu)(fu)面(mian)(mian)(mian)清(qing)單(dan)(dan)之外領域,無(wu)論是(shi)國(guo)有企(qi)業(ye)、民營企(qi)業(ye),還是(shi)大(da)企(qi)業(ye)、中小企(qi)業(ye),各(ge)(ge)(ge)(ge)類經(jing)(jing)營主(zhu)(zhu)體(ti)(ti)皆可(ke)(ke)(ke)依(yi)法(fa)(fa)平等(deng)進(jin)入(ru)(ru)(ru)(ru)(ru)(ru)(ru)(ru);嚴禁各(ge)(ge)(ge)(ge)級(ji)政府部(bu)(bu)門在(zai)清(qing)單(dan)(dan)之外違(wei)(wei)規(gui)(gui)設(she)(she)(she)立準(zhun)(zhun)入(ru)(ru)(ru)(ru)(ru)(ru)(ru)(ru)許可(ke)(ke)(ke)、違(wei)(wei)規(gui)(gui)增設(she)(she)(she)準(zhun)(zhun)入(ru)(ru)(ru)(ru)(ru)(ru)(ru)(ru)條件(jian)(jian)、違(wei)(wei)規(gui)(gui)設(she)(she)(she)置準(zhun)(zhun)入(ru)(ru)(ru)(ru)(ru)(ru)(ru)(ru)障礙,從(cong)(cong)而將“剩(sheng)余決定(ding)權(quan)(quan)”賦予(yu)經(jing)(jing)營主(zhu)(zhu)體(ti)(ti),推(tui)動企(qi)業(ye)在(zai)公平競爭中優勝(sheng)劣汰、實(shi)現高質(zhi)(zhi)量(liang)發展。

 問:2024年8月,中共中央辦公廳、國務院辦公廳印發《關于完善市場準入制度的意見》(以下簡稱《意見》),提出了“完善市場準入負面清單管理模式”的要求。這次清單修訂對清單總體制度設計作出了哪些優化?

  答:近(jin)年來,黨中(zhong)央(yang)、國(guo)(guo)(guo)務(wu)(wu)院(yuan)對(dui)(dui)(dui)于(yu)完(wan)(wan)善(shan)市(shi)(shi)場(chang)準(zhun)(zhun)(zhun)(zhun)(zhun)入(ru)制(zhi)(zhi)度作(zuo)(zuo)出(chu)重(zhong)大部(bu)署,提(ti)出(chu)了不少新規(gui)(gui)(gui)(gui)定(ding)(ding)(ding)、新要(yao)(yao)(yao)求(qiu)(qiu)(qiu),特別是(shi)(shi)(shi)《意(yi)見》對(dui)(dui)(dui)于(yu)完(wan)(wan)善(shan)負(fu)面(mian)(mian)清(qing)(qing)(qing)(qing)(qing)(qing)單(dan)(dan)管(guan)(guan)(guan)理模式(shi)作(zuo)(zuo)出(chu)了明確(que)安排。《清(qing)(qing)(qing)(qing)(qing)(qing)單(dan)(dan)(2025年版》是(shi)(shi)(shi)《意(yi)見》發布后的(de)(de)(de)(de)首版清(qing)(qing)(qing)(qing)(qing)(qing)單(dan)(dan),在(zai)保持制(zhi)(zhi)度基本要(yao)(yao)(yao)求(qiu)(qiu)(qiu)和清(qing)(qing)(qing)(qing)(qing)(qing)單(dan)(dan)體(ti)(ti)例架構(gou)總體(ti)(ti)穩定(ding)(ding)(ding)的(de)(de)(de)(de)基礎上(shang)(shang),圍(wei)(wei)繞貫(guan)徹上(shang)(shang)述要(yao)(yao)(yao)求(qiu)(qiu)(qiu),作(zuo)(zuo)出(chu)了多方(fang)面(mian)(mian)優(you)化,具(ju)體(ti)(ti)可(ke)以(yi)(yi)概括為“四個(ge)完(wan)(wan)善(shan)”。一(yi)是(shi)(shi)(shi)完(wan)(wan)善(shan)“全國(guo)(guo)(guo)一(yi)張清(qing)(qing)(qing)(qing)(qing)(qing)單(dan)(dan)”管(guan)(guan)(guan)理要(yao)(yao)(yao)求(qiu)(qiu)(qiu)。一(yi)方(fang)面(mian)(mian),強化“全國(guo)(guo)(guo)一(yi)張清(qing)(qing)(qing)(qing)(qing)(qing)單(dan)(dan)”權(quan)威(wei)性,明確(que)產業(ye)、投(tou)資、互聯網、重(zhong)點生態功能(neng)(neng)區等各類(lei)按(an)要(yao)(yao)(yao)求(qiu)(qiu)(qiu)編制(zhi)(zhi)的(de)(de)(de)(de)全國(guo)(guo)(guo)層面(mian)(mian)準(zhun)(zhun)(zhun)(zhun)(zhun)入(ru)類(lei)清(qing)(qing)(qing)(qing)(qing)(qing)單(dan)(dan)目(mu)錄,全部(bu)納入(ru)市(shi)(shi)場(chang)準(zhun)(zhun)(zhun)(zhun)(zhun)入(ru)負(fu)面(mian)(mian)清(qing)(qing)(qing)(qing)(qing)(qing)單(dan)(dan)管(guan)(guan)(guan)理,這些清(qing)(qing)(qing)(qing)(qing)(qing)單(dan)(dan)目(mu)錄修訂(ding)中(zhong),如涉及(ji)提(ti)高市(shi)(shi)場(chang)準(zhun)(zhun)(zhun)(zhun)(zhun)入(ru)門檻,應按(an)照(zhao)負(fu)面(mian)(mian)清(qing)(qing)(qing)(qing)(qing)(qing)單(dan)(dan)措(cuo)施(shi)調(diao)整(zheng)程序要(yao)(yao)(yao)求(qiu)(qiu)(qiu),報國(guo)(guo)(guo)務(wu)(wu)院(yuan)同意(yi)。另一(yi)方(fang)面(mian)(mian),完(wan)(wan)善(shan)特定(ding)(ding)(ding)區域(yu)放寬準(zhun)(zhun)(zhun)(zhun)(zhun)入(ru)制(zhi)(zhi)度安排,明確(que)依法在(zai)特定(ding)(ding)(ding)區域(yu)調(diao)整(zheng)或暫(zan)停(ting)實(shi)施(shi)市(shi)(shi)場(chang)準(zhun)(zhun)(zhun)(zhun)(zhun)入(ru)管(guan)(guan)(guan)理措(cuo)施(shi)的(de)(de)(de)(de),負(fu)面(mian)(mian)清(qing)(qing)(qing)(qing)(qing)(qing)單(dan)(dan)與之直接(jie)銜(xian)(xian)接(jie),支持地(di)方(fang)先行先試、深化改革探(tan)索。二是(shi)(shi)(shi)完(wan)(wan)善(shan)市(shi)(shi)場(chang)準(zhun)(zhun)(zhun)(zhun)(zhun)入(ru)事(shi)(shi)項(xiang)(xiang)實(shi)施(shi)要(yao)(yao)(yao)求(qiu)(qiu)(qiu)。對(dui)(dui)(dui)于(yu)清(qing)(qing)(qing)(qing)(qing)(qing)單(dan)(dan)所列(lie)的(de)(de)(de)(de)許(xu)可(ke)準(zhun)(zhun)(zhun)(zhun)(zhun)入(ru)事(shi)(shi)項(xiang)(xiang),明確(que)要(yao)(yao)(yao)求(qiu)(qiu)(qiu)地(di)方(fang)各級政府(fu)公(gong)開法律法規(gui)(gui)(gui)(gui)依據、技(ji)術(shu)標(biao)準(zhun)(zhun)(zhun)(zhun)(zhun)、許(xu)可(ke)要(yao)(yao)(yao)求(qiu)(qiu)(qiu)、辦(ban)(ban)理時限,制(zhi)(zhi)定(ding)(ding)(ding)市(shi)(shi)場(chang)準(zhun)(zhun)(zhun)(zhun)(zhun)入(ru)服(fu)(fu)務(wu)(wu)規(gui)(gui)(gui)(gui)程,由經(jing)(jing)(jing)營(ying)(ying)主(zhu)(zhu)體(ti)(ti)按(an)照(zhao)規(gui)(gui)(gui)(gui)定(ding)(ding)(ding)的(de)(de)(de)(de)條(tiao)件(jian)和方(fang)式(shi)合(he)規(gui)(gui)(gui)(gui)進(jin)(jin)入(ru),同時提(ti)出(chu),對(dui)(dui)(dui)未實(shi)施(shi)市(shi)(shi)場(chang)禁(jin)入(ru)或許(xu)可(ke)準(zhun)(zhun)(zhun)(zhun)(zhun)入(ru)但按(an)照(zhao)備(bei)案管(guan)(guan)(guan)理的(de)(de)(de)(de)事(shi)(shi)項(xiang)(xiang),不得以(yi)(yi)備(bei)案名義(yi)變相(xiang)設立(li)許(xu)可(ke),進(jin)(jin)一(yi)步推動規(gui)(gui)(gui)(gui)范(fan)透(tou)明準(zhun)(zhun)(zhun)(zhun)(zhun)入(ru)。三(san)是(shi)(shi)(shi)完(wan)(wan)善(shan)與其(qi)他準(zhun)(zhun)(zhun)(zhun)(zhun)入(ru)規(gui)(gui)(gui)(gui)定(ding)(ding)(ding)銜(xian)(xian)接(jie)要(yao)(yao)(yao)求(qiu)(qiu)(qiu)。明確(que)境(jing)內外經(jing)(jing)(jing)營(ying)(ying)主(zhu)(zhu)體(ti)(ti)在(zai)中(zhong)國(guo)(guo)(guo)境(jing)內開展投(tou)資經(jing)(jing)(jing)營(ying)(ying),統一(yi)適用市(shi)(shi)場(chang)準(zhun)(zhun)(zhun)(zhun)(zhun)入(ru)負(fu)面(mian)(mian)清(qing)(qing)(qing)(qing)(qing)(qing)單(dan)(dan)的(de)(de)(de)(de)各項(xiang)(xiang)規(gui)(gui)(gui)(gui)定(ding)(ding)(ding),落實(shi)國(guo)(guo)(guo)民待遇要(yao)(yao)(yao)求(qiu)(qiu)(qiu)。在(zai)此基礎上(shang)(shang),境(jing)外投(tou)資者在(zai)中(zhong)國(guo)(guo)(guo)境(jing)內投(tou)資還(huan)需適用《外商(shang)投(tou)資準(zhun)(zhun)(zhun)(zhun)(zhun)入(ru)特別管(guan)(guan)(guan)理措(cuo)施(shi)(負(fu)面(mian)(mian)清(qing)(qing)(qing)(qing)(qing)(qing)單(dan)(dan))》的(de)(de)(de)(de)有(you)關規(gui)(gui)(gui)(gui)定(ding)(ding)(ding);境(jing)外服(fu)(fu)務(wu)(wu)提(ti)供(gong)(gong)者以(yi)(yi)跨境(jing)形(xing)式(shi)向中(zhong)國(guo)(guo)(guo)境(jing)內提(ti)供(gong)(gong)服(fu)(fu)務(wu)(wu)的(de)(de)(de)(de),還(huan)需適用《跨境(jing)服(fu)(fu)務(wu)(wu)貿易特別管(guan)(guan)(guan)理措(cuo)施(shi)(負(fu)面(mian)(mian)清(qing)(qing)(qing)(qing)(qing)(qing)單(dan)(dan))》的(de)(de)(de)(de)有(you)關規(gui)(gui)(gui)(gui)定(ding)(ding)(ding)。四是(shi)(shi)(shi)完(wan)(wan)善(shan)市(shi)(shi)場(chang)準(zhun)(zhun)(zhun)(zhun)(zhun)入(ru)規(gui)(g   此外,這(zhe)次修訂(ding)對清(qing)單(dan)事項適(shi)用范圍、準入后綜合監管、信(xin)用承(cheng)諾及履(lv)約要(yao)求(qiu)等表(biao)述作(zuo)出(chu)了一些技術性修訂(ding),以更好反映目前清(qing)單(dan)實施(shi)情(qing)況。

  問:《清單(2025年版)》與上一版清單相比,事項數量由117項縮減到106項,請問具體的準入措施調整情況如何?

  答:《清(qing)單(2025年版)》修訂(ding)堅持“該(gai)減的(de)堅決減,該(gai)增(zeng)的(de)合理(li)增(zeng)”,全(quan)面體現近年來(lai)法律法規“立改廢釋”和(he)行(xing)政審批制度改革成果(guo),事項數量由2022年版的(de)117項縮減至106項,事項下的(de)全(quan)國性具體管理(li)措施由486條縮減至469條,地方(fang)性管理(li)措施由36條縮減至20條。具體包括兩個(ge)方(fang)面:

  一方(fang)面(mian),降低準(zhun)入門檻,激發市(shi)場活力。直接(jie)刪除(chu)了(le)一批全國性(xing)措(cuo)施(shi)(shi)。如(ru)(ru)公章刻制(zhi)(zhi)業(ye)(ye)(ye)由許可制(zhi)(zhi)改(gai)為備案制(zhi)(zhi),計(ji)算(suan)機信(xin)息系統(tong)安全專用產品(pin)銷(xiao)售業(ye)(ye)(ye)務(wu)改(gai)革為基于強制(zhi)(zhi)性(xing)國家標準(zhun)的(de)(de)檢測認證(zheng)制(zhi)(zhi)度(du)。部分放開了(le)一批全國性(xing)措(cuo)施(shi)(shi)。如(ru)(ru)取消電(dian)視劇制(zhi)(zhi)作單(dan)位設立(li)、藥(yao)品(pin)批發零售企業(ye)(ye)(ye)籌建、藥(yao)品(pin)和(he)醫療器械互聯網信(xin)息服(fu)務(wu)、醫療機構使用放射(she)性(xing)藥(yao)品(pin)(一、二類(lei))、試辦新型電(dian)信(xin)業(ye)(ye)(ye)務(wu)、林(lin)木種子進(jin)口、增值稅發票印制(zhi)(zhi)等管理(li)(li)措(cuo)施(shi)(shi),相關領域(yu)保持必要市(shi)場準(zhun)入管理(li)(li),但(dan)準(zhun)入環節更加精簡。取消了(le)一批地方(fang)性(xing)措(cuo)施(shi)(shi)。如(ru)(ru)推動各地放開交通(tong)物(wu)流、貨運代(dai)理(li)(li)、車輛租(zu)賃服(fu)務(wu)、生產性(xing)廢舊金屬收購等管理(li)(li)措(cuo)施(shi)(shi),打通(tong)區域(yu)間市(shi)場壁壘;取消有關地方(fang)設立(li)的(de)(de)船舶設計(ji)修(xiu)造、酒類(lei)生產經營、權益(yi)類(lei)大(da)宗商(shang)品(pin)交易等管理(li)(li)措(cuo)施(shi)(shi),實施(shi)(shi)全國統(tong)一的(de)(de)準(zhun)入方(fang)式。

  另一(yi)方面,依(yi)(yi)(yi)法(fa)(fa)規(gui)范(fan)重(zhong)點領(ling)域(yu)準(zhun)入,兜牢安(an)全(quan)(quan)底線。依(yi)(yi)(yi)據(ju)已出臺(tai)的法(fa)(fa)律(lv)、行政法(fa)(fa)規(gui)、國務院(yuan)決定(ding)等,對部分領(ling)域(yu)市場(chang)準(zhun)入作了(le)進一(yi)步規(gui)范(fan)。納入新(xin)業(ye)(ye)態(tai)新(xin)領(ling)域(yu)管(guan)(guan)理(li)(li)(li)措施(shi)。依(yi)(yi)(yi)據(ju)《無(wu)人駕駛航(hang)空(kong)(kong)器(qi)運(yun)營管(guan)(guan)理(li)(li)(li)條(tiao)(tiao)例》,將“民(min)(min)(min)用(yong)無(wu)人駕駛航(hang)空(kong)(kong)器(qi)運(yun)營合(he)格證核發(微型(xing)無(wu)人駕駛航(hang)空(kong)(kong)器(qi)除外)”納入清(qing)單(dan)。依(yi)(yi)(yi)據(ju)《中(zhong)華人民(min)(min)(min)共和(he)國煙草專賣法(fa)(fa)實(shi)施(shi)條(tiao)(tiao)例》,將電子煙等新(xin)型(xing)煙草制(zhi)品(pin)(pin)生(sheng)產(chan)(chan)、批(pi)發、零售業(ye)(ye)務相關審批(pi)納入清(qing)單(dan)。依(yi)(yi)(yi)據(ju)《中(zhong)華人民(min)(min)(min)共和(he)國藥品(pin)(pin)管(guan)(guan)理(li)(li)(li)法(fa)(fa)》和(he)《醫療器(qi)械監督管(guan)(guan)理(li)(li)(li)條(tiao)(tiao)例》,規(gui)范(fan)醫藥和(he)醫療器(qi)械網絡銷(xiao)售準(zhun)入條(tiao)(tiao)件。強化重(zhong)點領(ling)域(yu)風險防控。依(yi)(yi)(yi)據(ju)《中(zhong)華人民(min)(min)(min)共和(he)國期貨和(he)衍生(sheng)品(pin)(pin)法(fa)(fa)》,明確非金融機構(gou)不得違(wei)法(fa)(fa)使用(yong)“期貨公司”字樣(yang)。依(yi)(yi)(yi)據(ju)《國務院(yuan)關于調整完善工(gong)業(ye)(ye)產(chan)(chan)品(pin)(pin)生(sheng)產(chan)(chan)許(xu)可證管(guan)(guan)理(li)(li)(li)目錄的決定(ding)》,將重(zhong)要工(gong)業(ye)(ye)產(chan)(chan)品(pin)(pin)許(xu)可證管(guan)(guan)理(li)(li)(li)范(fan)圍從10大(da)類(lei)調整為14大(da)類(lei)27種,更好保障生(sheng)產(chan)(chan)安(an)全(quan)(quan)。

  經(jing)過2019、2020、2022、2025年四次修訂(ding),清(qing)單內的(de)事(shi)項(xiang)(xiang)數(shu)量已由2018年版(ban)的(de)151項(xiang)(xiang)壓減(jian)至目前的(de)106項(xiang)(xiang),壓減(jian)比例約30%,一大(da)批行業準入(ru)限(xian)制得(de)以放(fang)寬,各類經(jing)營主體都(dou)能看得(de)見(jian)、摸得(de)著(zhu)、進得(de)去,“寬準入(ru)”紅利切實(shi)賦能經(jing)濟(ji)社會發展,做到了(le)“清(qing)單越縮越短、市場越放(fang)越活”。

 問:據了解,國家發展改革委、商務部、市場監管總局等三部門在公布《清單(2025年版)》同時,還將開展市場準入壁壘清理整治行動,請問開展這次行動有哪些考慮?

  答:根據市(shi)(shi)場準(zhun)入(ru)(ru)(ru)負面(mian)清(qing)單制度要求(qiu),清(qing)單之(zhi)外的(de)(de)領域,各(ge)類經營主體都可以(yi)依法平等進入(ru)(ru)(ru),也(ye)就(jiu)是(shi)“非禁即入(ru)(ru)(ru)”。這(zhe)是(shi)負面(mian)清(qing)單管(guan)理模式最核心(xin)(xin)的(de)(de)要求(qiu),也(ye)是(shi)廣大(da)經營主體的(de)(de)熱切期(qi)盼。近年來(lai),國家發展改革委(wei)等有關(guan)部(bu)門(men)圍(wei)繞確保清(qing)單扎實落(luo)地,積極破(po)除(chu)(chu)各(ge)種形(xing)式的(de)(de)市(shi)(shi)場準(zhun)入(ru)(ru)(ru)壁(bi)壘,累計已向(xiang)社會公開通報7期(qi)115個違背市(shi)(shi)場準(zhun)入(ru)(ru)(ru)負面(mian)清(qing)單典(dian)型(xing)案(an)例,破(po)除(chu)(chu)了(le)一(yi)批基層(ceng)政(zheng)府關(guan)注、經營主體關(guan)心(xin)(xin)、人(ren)民(min)群眾關(guan)切的(de)(de)市(shi)(shi)場準(zhun)入(ru)(ru)(ru)障(zhang)礙,有力(li)保障(zhang)了(le)經營主體市(shi)(shi)場準(zhun)入(ru)(ru)(ru)權利。我(wo)們也(ye)看到,一(yi)些領域壁(bi)壘破(po)除(chu)(chu)后,企業投資的(de)(de)“心(xin)(xin)氣兒”上來(lai)了(le),“百花齊放”的(de)(de)競爭活力(li)得以(yi)涌現(xian),市(shi)(shi)場供給提質升級,供需(xu)兩(liang)旺(wang)的(de)(de)“熱乎(hu)勁”十分可喜(xi)。

  但是(shi)也要承認,清單之外“玻(bo)璃門(men)”“彈簧(huang)門(men)”“旋轉門(men)”等(deng)堵點卡(ka)點尚未消除,發現(xian)和(he)破(po)除市(shi)場(chang)(chang)(chang)準(zhun)入(ru)壁(bi)壘(lei)(lei)的(de)(de)機(ji)制還沒(mei)有完全成(cheng)熟,企業(ye)“上告無門(men)”“告而不理”“理而不決”等(deng)問題不同程度存在,還沒(mei)有完全做到(dao)“非禁即(ji)入(ru)”落地(di)生(sheng)根(gen)(gen)。國(guo)家發展改革(ge)委、商務部、市(shi)場(chang)(chang)(chang)監管(guan)總局聯合(he)(he)開(kai)展市(shi)場(chang)(chang)(chang)準(zhun)入(ru)壁(bi)壘(lei)(lei)清理整治行動(dong),目(mu)的(de)(de)就是(shi)要進一(yi)步大(da)力(li)破(po)除市(shi)場(chang)(chang)(chang)準(zhun)入(ru)壁(bi)壘(lei)(lei),全面清理和(he)整改違規(gui)設置市(shi)場(chang)(chang)(chang)準(zhun)入(ru)壁(bi)壘(lei)(lei)的(de)(de)各(ge)類不合(he)(he)理規(gui)定和(he)做法(fa),建(jian)立健全線索歸集、核實(shi)整改、案(an)例(li)通報(bao)等(deng)長效機(ji)制,讓“非禁即(ji)入(ru)”落地(di)生(sheng)根(gen)(gen),營造公平的(de)(de)市(shi)場(chang)(chang)(chang)準(zhun)入(ru)環境,為堅持和(he)落實(shi)“兩個毫不動(dong)搖(yao)”、構建(jian)全國(guo)統一(yi)大(da)市(shi)場(chang)(chang)(chang)提供有力(li)支撐。

  本次清理(li)整治的(de)(de)重(zhong)點(dian)是:以(yi)(yi)地(di)方性(xing)法規(gui)、規(gui)章、規(gui)范性(xing)文件(jian)(jian)、其(qi)他政(zheng)策性(xing)文件(jian)(jian)等形式設立和實行的(de)(de)違反市(shi)場準(zhun)(zhun)入(ru)制度(du)要(yao)求(qiu)的(de)(de)各類規(gui)定(ding)文件(jian)(jian),以(yi)(yi)及(ji)各級政(zheng)府違規(gui)設置市(shi)場準(zhun)(zhun)入(ru)壁(bi)壘的(de)(de)各類做法情形。

  本次清理(li)整(zheng)(zheng)治(zhi)的主要(yao)步(bu)驟包括:一是(shi)(shi)(shi)對涉及市場(chang)準入(ru)(ru)的各類(lei)規(gui)定文件進行(xing)全面(mian)清理(li),對違規(gui)增(zeng)設準入(ru)(ru)事(shi)項(xiang)或條件、違規(gui)擴大(da)準入(ru)(ru)范圍等情況(kuang),要(yao)一律糾正;對既無上位法依據,又無相應法定程序設立的市場(chang)準入(ru)(ru)規(gui)定,要(yao)一律廢止。二是(shi)(shi)(shi)開(kai)(kai)(kai)展線(xian)(xian)索(suo)歸(gui)集,通過(guo)政(zheng)府(fu)部門自查、公開(kai)(kai)(kai)征集等方式(shi),全面(mian)歸(gui)集各類(lei)渠(qu)道(dao)獲得的線(xian)(xian)索(suo)。三是(shi)(shi)(shi)進行(xing)個案(an)核(he)實(shi)整(zheng)(zheng)改(gai)(gai),各省發展改(gai)(gai)革(ge)部門會(hui)同(tong)商務、市場(chang)監(jian)管(guan)部門,對各類(lei)渠(qu)道(dao)歸(gui)集的問題線(xian)(xian)索(suo)進行(xing)匯總,推(tui)動轄區內各級(ji)地方政(zheng)府(fu)及其所(suo)屬(shu)部門限時(shi)核(he)實(shi)整(zheng)(zheng)改(gai)(gai)。四(si)是(shi)(shi)(shi)典型案(an)例公開(kai)(kai)(kai)通報,國家發展改(gai)(gai)革(ge)委按程序對轉(zhuan)辦問題線(xian)(xian)索(suo)核(he)實(shi)整(zheng)(zheng)改(gai)(gai)情況(kuang)和地方報送的典型案(an)例進行(xing)審核(he)后,按照“一案(an)一核(he)實(shi),一案(an)一通報”的原則進行(xing)公開(kai)(kai)(kai)通報、向社會(hui)公示(shi),并同(tong)步(bu)納入(ru)(ru)全國城市信用監(jian)測范圍。

  值得一提的是,本(ben)次(ci)清理整治行動邀(yao)請新(xin)(xin)華社(she)全程參與宣傳(chuan)報(bao)道和(he)輿論監(jian)督,共同建立線索共享、案例同查、典(dian)型共報(bao)、經驗(yan)同推工(gong)(gong)作(zuo)(zuo)機(ji)制,新(xin)(xin)華社(she)及國內分社(she)將對(dui)發(fa)現(xian)的突(tu)出問題、共性問題通過多種形式進(jin)行輿論監(jian)督,對(dui)典(dian)型案例和(he)工(gong)(gong)作(zuo)(zuo)中形成的經驗(yan)做法進(jin)行宣傳(chuan)報(bao)道,形成工(gong)(gong)作(zuo)(zuo)合力(li),力(li)求通過此次(ci)清理整治,助力(li)負面清單落地落實,進(jin)一步加(jia)快(kuai)全國統一大(da)市場(chang)建設。

  問:一些新業態新領域沒有直接納入負面清單管理,但企業想“入行”實際會遇到很多困難。請問國家發展改革委在這方面開展了哪些工作,取得了怎樣的效果?下一步還有哪些考慮?

  答(da):新(xin)業(ye)(ye)態新(xin)領域(yu)往往處在快速(su)發(fa)展期,創新(xin)主體(ti)(ti)多(duo)元、技術(shu)迭(die)代迅速(su)、發(fa)展路(lu)徑(jing)多(duo)變,難(nan)以用行政(zheng)審批的傳統準(zhun)(zhun)入(ru)(ru)方式進行管(guan)(guan)理,同時(shi)企業(ye)(ye)又容易遇到要素保(bao)障、標準(zhun)(zhun)制(zhi)定、市場(chang)監管(guan)(guan)、場(chang)景(jing)開放等方面的制(zhi)度供給短板(ban),難(nan)以進入(ru)(ru)市場(chang),需要探索更具柔性和(he)韌(ren)性的準(zhun)(zhun)入(ru)(ru)管(guan)(guan)理模式,開展體(ti)(ti)系性準(zhun)(zhun)入(ru)(ru)機制(zhi)設計,全面優化市場(chang)準(zhun)(zhun)入(ru)(ru)環境。

  黨(dang)的二(er)十屆三中全(quan)會作(zuo)出(chu)了“優化新(xin)業(ye)態新(xin)領域(yu)(yu)市(shi)場(chang)準(zhun)入(ru)環境”的重(zhong)大部(bu)署。《意(yi)見》明(ming)確(que)了具體(ti)(ti)落實安排。近年來,按照黨(dang)中央、國(guo)(guo)務(wu)院決策部(bu)署,國(guo)(guo)家發(fa)展改革委會同商務(wu)部(bu)、市(shi)場(chang)監管(guan)總局等(deng)(deng)有關部(bu)門,以放寬市(shi)場(chang)準(zhun)入(ru)特別措施(shi)為政(zheng)策載(zai)體(ti)(ti),先后在海(hai)南、深(shen)圳(zhen)、橫琴(qin)粵澳深(shen)度合(he)作(zuo)區(qu)(qu)、廣州(zhou)南沙新(xin)區(qu)(qu)等(deng)(deng)地,謀(mou)劃推(tui)出(chu)了一(yi)批體(ti)(ti)系(xi)性、突破性較強的政(zheng)策舉措,在航(hang)空(kong)航(hang)天、生物醫(yi)藥、新(xin)型能源(yuan)、信息安全(quan)、智慧(hui)交通等(deng)(deng)領域(yu)(yu)取得一(yi)系(xi)列標志性成果。例如,支持(chi)(chi)海(hai)南組建全(quan)國(guo)(guo)首個商業(ye)航(hang)天發(fa)射場(chang),打(da)破我國(guo)(guo)商業(ye)航(hang)天“發(fa)射難”堵點卡點;支持(chi)(chi)深(shen)圳(zhen)建立全(quan)國(guo)(guo)首個電子元器件和(he)集成電路(lu)國(guo)(guo)際(ji)交易平臺,打(da)通供應鏈和(he)產業(ye)鏈融合(he)渠道;支持(chi)(chi)安徽合(he)肥(fei)、橫琴(qin)粵澳深(shen)度合(he)作(zuo)區(qu)(qu)、廣州(zhou)南沙新(xin)區(qu)(qu)構建海(hai)陸空(kong)全(quan)空(kong)間無(wu)人(ren)體(ti)(ti)系(xi)準(zhun)入(ru)標準(zhun),有力破除(chu)運營體(ti)(ti)制、空(kong)域(yu)(yu)規(gui)劃、數(shu)據安全(quan)、場(chang)景開放等(deng)(deng)障(zhang)礙等(deng)(deng)。

  下一步(bu),我們將繼續加大(da)改(gai)革創新(xin)力(li)度,從兩個方(fang)面把(ba)優化新(xin)業態新(xin)領域(yu)(yu)(yu)市(shi)場(chang)(chang)(chang)(chang)準(zhun)入(ru)(ru)(ru)環境的(de)部署(shu)要求落到實(shi)處(chu)。一方(fang)面,強化重(zhong)(zhong)(zhong)(zhong)點(dian)(dian)(dian)突破,完(wan)善監管模式(shi)。聚焦(jiao)重(zhong)(zhong)(zhong)(zhong)要領域(yu)(yu)(yu)、重(zhong)(zhong)(zhong)(zhong)點(dian)(dian)(dian)行業,充分挖掘場(chang)(chang)(chang)(chang)景開放創新(xin)需求,謀劃推(tui)(tui)出具(ju)有(you)(you)引領性、示范性、帶(dai)動(dong)性的(de)超級(ji)場(chang)(chang)(chang)(chang)景,加快形成(cheng)“技術突破——場(chang)(chang)(chang)(chang)景驗證——產(chan)(chan)業應用(yong)——創新(xin)生態”正向循環,推(tui)(tui)動(dong)新(xin)產(chan)(chan)業新(xin)模式(shi)新(xin)動(dong)能發展。另一方(fang)面,強化試(shi)點(dian)(dian)(dian)建設,加快升(sheng)(sheng)級(ji)迭代(dai)。圍繞(rao)戰略性新(xin)興產(chan)(chan)業、未來產(chan)(chan)業重(zhong)(zhong)(zhong)(zhong)點(dian)(dian)(dian)領域(yu)(yu)(yu)和重(zhong)(zhong)(zhong)(zhong)大(da)生產(chan)(chan)力(li)布局(ju),選擇重(zhong)(zhong)(zhong)(zhong)點(dian)(dian)(dian)地區開展放寬市(shi)場(chang)(chang)(chang)(chang)準(zhun)入(ru)(ru)(ru)試(shi)點(dian)(dian)(dian),分批(pi)制定和推(tui)(tui)出新(xin)的(de)放寬市(shi)場(chang)(chang)(chang)(chang)準(zhun)入(ru)(ru)(ru)特(te)別措(cuo)施(shi)。推(tui)(tui)動(dong)試(shi)點(dian)(dian)(dian)相對成(cheng)熟的(de)已有(you)(you)特(te)別措(cuo)施(shi)增點(dian)(dian)(dian)擴面、體(ti)系迭代(dai),適時(shi)上升(sheng)(sheng)為全國層面制度性成(cheng)果,推(tui)(tui)動(dong)市(shi)場(chang)(chang)(chang)(chang)準(zhun)入(ru)(ru)(ru)負面清單事(shi)項進(jin)一步(bu)精簡(jian)優化。

 問:此次清單修訂“放”了一批市場準入管理措施,釋放了改革紅利。但“放”了之后如何“管”,也廣受各方關注,請問后續將如何加強準入后監管,有效維護市場秩序?

  答:《清單(2025年(nian)版)》在“說明(ming)(ming)”部分專門提(ti)出綜合(he)監(jian)(jian)管(guan)要(yao)求,明(ming)(ming)確(que)各級政(zheng)府(fu)部門要(yao)按照職責分工,堅決查(cha)處違法違規進入行(xing)為(wei),依法依規對(dui)經營主體(ti)實施準(zhun)入后監(jian)(jian)管(guan),做(zuo)到事(shi)前事(shi)中事(shi)后監(jian)(jian)管(guan)全覆蓋,杜(du)絕監(jian)(jian)管(guan)盲區和(he)真空。同時特別提(ti)出,要(yao)推(tui)動構(gou)建政(zheng)府(fu)監(jian)(jian)管(guan)、企業(ye)自(zi)覺、行(xing)業(ye)自(zi)律、社(she)會(hui)監(jian)(jian)督互為(wei)支撐的協同監(jian)(jian)管(guan)格局(ju),指明(ming)(ming)了下一階段加強市場準(zhun)入全鏈條(tiao)監(jian)(jian)管(guan)的基本方向。

  具(ju)體(ti)來講,就是(shi)要充(chong)分發揮政府(fu)、企業(ye)(ye)、行(xing)業(ye)(ye)、社(she)會(hui)協同作(zuo)用(yong)(yong),以準(zhun)入(ru)(ru)(ru)監(jian)(jian)(jian)管新理念(nian)、新機(ji)制保障市場(chang)準(zhun)入(ru)(ru)(ru)“放而有序(xu)”。一(yi)是(shi)政府(fu)方(fang)面(mian),嚴格按照法定程序(xu)進行(xing)監(jian)(jian)(jian)管,創(chuang)新監(jian)(jian)(jian)管方(fang)式,構建“準(zhun)入(ru)(ru)(ru)+監(jian)(jian)(jian)管”閉環(huan)管理機(ji)制,推(tui)進跨部門綜合監(jian)(jian)(jian)管。二是(shi)企業(ye)(ye)方(fang)面(mian),提升企業(ye)(ye)科學(xue)管理水平(ping)(ping),倡導(dao)企業(ye)(ye)履行(xing)社(she)會(hui)責任,優化企業(ye)(ye)綜合監(jian)(jian)(jian)管體(ti)系(xi)。三是(shi)行(xing)業(ye)(ye)方(fang)面(mian),發揮行(xing)業(ye)(ye)組(zu)織規范(fan)經營主體(ti)行(xing)為的作(zuo)用(yong)(yong),鼓勵行(xing)業(ye)(ye)組(zu)織為準(zhun)入(ru)(ru)(ru)監(jian)(jian)(jian)管提供標準(zhun)體(ti)系(xi)、認(ren)證認(ren)可、服務質量、節能(neng)環(huan)保、安全衛生等方(fang)面(mian)支撐。四是(shi)社(she)會(hui)方(fang)面(mian),推(tui)動形成監(jian)(jian)(jian)督合力,將市場(chang)準(zhun)入(ru)(ru)(ru)各環(huan)節“放在陽(yang)光下”,營造更(geng)加穩定、公平(ping)(ping)、透明、可預期的準(zhun)入(ru)(ru)(ru)環(huan)境。

  此前(qian),國家發展改革委、商務部、市場監(jian)管(guan)總(zong)局已于(yu)2023年12月聯合印發《關于(yu)支(zhi)(zhi)持廣州(zhou)南沙放寬市場準入(ru)與加強(qiang)監(jian)管(guan)體制(zhi)改革的(de)(de)意見》,支(zhi)(zhi)持廣州(zhou)南沙選取特(te)定監(jian)管(guan)場景,探(tan)索將放寬市場準入(ru)與優化監(jian)管(guan)緊密結合,健全(quan)完(wan)善與放寬市場準入(ru)相適應的(de)(de)全(quan)鏈條監(jian)管(guan)體系,取得(de)初步(bu)成果。下一步(bu),我們將持續深(shen)化改革探(tan)索、拓展試點領域,為全(quan)國層(ceng)面制(zhi)度(du)建(jian)設積累寶(bao)貴經驗,以優化監(jian)管(guan)機制(zhi)保障放寬市場準入(ru)的(de)(de)政策紅利落到實處
