近期,住房城鄉建設部發布了《住房城鄉建設(she)領域公(gong)共(gong)信(xin)用(yong)信(xin)息目(mu)錄(2024年版)》(以下簡稱《目(mu)錄(lu)》),《中國建設(she)報》邀(yao)請青島理(li)工大學城(cheng)鄉建設(she)信用和風(feng)險管理(li)研究中心執行(xing)主任(ren)李曉冬對(dui)《目(mu)錄(lu)》有(you)關(guan)內容進行(xing)了(le)解(jie)讀(du)。
問:發布《目錄》的背景和目的是什么?
答:黨的(de)二十大(da)(da)報(bao)告(gao)提出社(she)(she)會信(xin)用(yong)(yong)(yong)是(shi)社(she)(she)會主義市(shi)場經濟(ji)的(de)基礎制(zhi)度之一,是(shi)構(gou)建全國(guo)統(tong)一大(da)(da)市(shi)場、優(you)化營商(shang)環(huan)境的(de)重要(yao)一環(huan)。黨中央、國(guo)務院要(yao)求(qiu)加強(qiang)信(xin)用(yong)(yong)(yong)管理(li),公(gong)(gong)共(gong)信(xin)用(yong)(yong)(yong)管理(li)應當(dang)界限清晰、目錄完善(shan)、過懲相(xiang)當(dang)。在此(ci)背景下,國(guo)家發(fa)(fa)(fa)展改革(ge)委、人民(min)銀行年(nian)初牽(qian)頭(tou)發(fa)(fa)(fa)布(bu)了《》(以下簡稱《基礎目錄》),對各領(ling)域13大(da)(da)類公(gong)(gong)共(gong)信(xin)用(yong)(yong)(yong)信(xin)息做出規范界定。以此(ci)為基礎,住(zhu)房城鄉建設(she)部對涉及本領(ling)域的(de)信(xin)用(yong)(yong)(yong)信(xin)息進行細化梳(shu)理(li),發(fa)(fa)(fa)布(bu)了《目錄》,其目的(de)是(shi)為住(zhu)房城鄉建設(she)領(ling)域公(gong)(gong)共(gong)信(xin)用(yong)(yong)(yong)信(xin)息歸集(ji)提供目錄支撐。
歸集共(gong)享住(zhu)(zhu)房(fang)(fang)城(cheng)(cheng)鄉建(jian)(jian)設(she)(she)領域公共(gong)信(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)息(xi)(xi),是推動住(zhu)(zhu)房(fang)(fang)城(cheng)(cheng)鄉建(jian)(jian)設(she)(she)事(shi)業高質量發展的必然要求。黨的十八(ba)大(da)以來,住(zhu)(zhu)房(fang)(fang)城(cheng)(cheng)鄉建(jian)(jian)設(she)(she)部門積極貫徹落實黨中央、國(guo)務(wu)院有(you)(you)關決策部署,社會信(xin)(xin)用(yong)(yong)(yong)體系建(jian)(jian)設(she)(she)工作(zuo)取得(de)了積極成(cheng)效(xiao)。例如,在一(yi)些(xie)地區積極探索開展重點行業信(xin)(xin)用(yong)(yong)(yong)評(ping)價,取得(de)一(yi)些(xie)成(cheng)效(xiao),豐富了事(shi)中事(shi)后監管手段。但仍有(you)(you)不足(zu),存(cun)在信(xin)(xin)用(yong)(yong)(yong)數據“孤島”、“信(xin)(xin)用(yong)(yong)(yong)不出省、市”情況,不利于(yu)構(gou)建(jian)(jian)全國(guo)統(tong)一(yi)大(da)市場。其(qi)中,缺乏全國(guo)統(tong)一(yi)的信(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)息(xi)(xi)管理制度是一(yi)個(ge)重要因(yin)素(su)。住(zhu)(zhu)房(fang)(fang)城(cheng)(cheng)鄉建(jian)(jian)設(she)(she)部發布的《目錄》,將為建(jian)(jian)設(she)(she)覆蓋全系統(tong)的信(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)息(xi)(xi)歸集平(ping)臺、實現公共(gong)信(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)息(xi)(xi)統(tong)一(yi)歸集共(gong)享奠定(ding)基礎。
問:《目錄》中主要涉及哪些公共信用信息?
答:公(gong)(gong)共(gong)信(xin)(xin)(xin)(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)(xin)(xin)(xin)息(xi)(xi)(xi)(xi)(xi)是(shi)指國家機關(guan)和(he)法(fa)律、法(fa)規授權具有管理公(gong)(gong)共(gong)事務(wu)職(zhi)能(neng)的(de)(de)組(zu)織在履(lv)行法(fa)定職(zhi)責、提供公(gong)(gong)共(gong)服務(wu)過(guo)程中產(chan)生和(he)獲取的(de)(de)信(xin)(xin)(xin)(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)(xin)(xin)(xin)息(xi)(xi)(xi)(xi)(xi)。住(zhu)房城(cheng)鄉建設(she)領(ling)域共(gong)涉(she)及(ji)9大類(lei)85項信(xin)(xin)(xin)(xin)(xin)(xin)息(xi)(xi)(xi)(xi)(xi)條目,包(bao)括登記(ji)(ji)注冊基本(ben)信(xin)(xin)(xin)(xin)(xin)(xin)息(xi)(xi)(xi)(xi)(xi)、行政管理信(xin)(xin)(xin)(xin)(xin)(xin)息(xi)(xi)(xi)(xi)(xi)、職(zhi)稱和(he)職(zhi)業資格信(xin)(xin)(xin)(xin)(xin)(xin)息(xi)(xi)(xi)(xi)(xi)、嚴重(zhong)失(shi)信(xin)(xin)(xin)(xin)(xin)(xin)主(zhu)體名單信(xin)(xin)(xin)(xin)(xin)(xin)息(xi)(xi)(xi)(xi)(xi)、信(xin)(xin)(xin)(xin)(xin)(xin)用(yong)承諾及(ji)履(lv)行情況(kuang)信(xin)(xin)(xin)(xin)(xin)(xin)息(xi)(xi)(xi)(xi)(xi)、信(xin)(xin)(xin)(xin)(xin)(xin)用(yong)評價(jia)結果(guo)信(xin)(xin)(xin)(xin)(xin)(xin)息(xi)(xi)(xi)(xi)(xi)、遵守法(fa)律法(fa)規情況(kuang)信(xin)(xin)(xin)(xin)(xin)(xin)息(xi)(xi)(xi)(xi)(xi)、守信(xin)(xin)(xin)(xin)(xin)(xin)相關(guan)榮(rong)譽信(xin)(xin)(xin)(xin)(xin)(xin)息(xi)(xi)(xi)(xi)(xi)、經(jing)營主(zhu)體自愿提供的(de)(de)信(xin)(xin)(xin)(xin)(xin)(xin)息(xi)(xi)(xi)(xi)(xi)。各級住(zhu)房城(cheng)鄉建設(she)部(bu)門可(ke)以在日常監管中采集(ji)《目錄(lu)》中信(xin)(xin)(xin)(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)(xin)(xin)(xin)息(xi)(xi)(xi)(xi)(xi),記(ji)(ji)入市場主(zhu)體信(xin)(xin)(xin)(xin)(xin)(xin)用(yong)記(ji)(ji)錄(lu)。未列入的(de)(de)不(bu)可(ke)以作為公(gong)(gong)共(gong)信(xin)(xin)(xin)(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)(xin)(xin)(xin)息(xi)(xi)(xi)(xi)(xi)來使用(yong)。
問:《目錄》有哪些特點?
答:《目錄》堅持(chi)“依法(fa)依規、保護權益(yi)、審慎適(shi)度、清(qing)單管(guan)理”原則,對于涉(she)及市場主體切(qie)身權益(yi)的信用記錄,嚴格落(luo)實(shi)列入必須“有(you)法(fa)律法(fa)規或黨(dang)中央、國(guo)務院政策文件(jian)作為依據”。此外,本著(zhu)審慎適(shi)度的原則,一些尚未(wei)(wei)達成普遍共識的,暫未(wei)(wei)列入本版目錄。
《目錄》涉及行業(ye)眾多,85項信(xin)息條(tiao)目看似(si)不(bu)多,但(dan)涉及了“衣食住(zhu)行”“安居(ju)樂業(ye)”,與(yu)人民群眾生產(chan)生活都息息相關,確實是關乎國計民生的大(da)事(shi)。
《目錄》考(kao)(kao)慮(lv)了信用監(jian)管實(shi)際需求。例如(ru),實(shi)際工作中(zhong)存在一(yi)個典型問題,就是(shi)守信成本高、失(shi)信成本低,單(dan)一(yi)行(xing)政處罰(fa)難(nan)以發揮震懾作用,影響了政府公信力。《目錄》列入(ru)建(jian)設(she)工程抗震、城建(jian)檔案、住(zhu)房公積(ji)金等行(xing)業(ye)違法違規信息就是(shi)考(kao)(kao)慮(lv)這類(lei)情況。
問:除了《目錄》發布,住房城鄉建設部門還應關注哪些信用工作?
答:黨的(de)二十屆三中全(quan)會要求(qiu),在當前(qian)發(fa)展新質(zhi)生(sheng)產力的(de)關(guan)(guan)鍵時期(qi),應完善信(xin)(xin)(xin)用(yong)(yong)監管等(deng)市場(chang)(chang)經濟(ji)基礎制度。近年來(lai),住房(fang)城(cheng)鄉建(jian)(jian)設(she)部一直在積極(ji)推(tui)進“兩個(ge)基礎”工作(zuo)。一是(shi)加強立(li)法(fa)(fa)。例如推(tui)動(dong)《物業管理(li)(li)(li)(li)條例》《建(jian)(jian)設(she)工程抗(kang)震管理(li)(li)(li)(li)條例》等(deng)行(xing)政法(fa)(fa)規(gui)設(she)立(li)信(xin)(xin)(xin)用(yong)(yong)管理(li)(li)(li)(li)規(gui)定,研究(jiu)起草住房(fang)城(cheng)鄉建(jian)(jian)設(she)重點(dian)領域嚴重失信(xin)(xin)(xin)主體名單管理(li)(li)(li)(li)暫(zan)行(xing)辦(ban)法(fa)(fa)、住房(fang)城(cheng)鄉建(jian)(jian)設(she)領域信(xin)(xin)(xin)用(yong)(yong)修(xiu)復(fu)暫(zan)行(xing)辦(ban)法(fa)(fa)、建(jian)(jian)筑市場(chang)(chang)信(xin)(xin)(xin)用(yong)(yong)管理(li)(li)(li)(li)辦(ban)法(fa)(fa)等(deng),將為行(xing)業開(kai)展信(xin)(xin)(xin)用(yong)(yong)監管提供依據(ju)。二是(shi)夯(hang)實數據(ju)基礎。國務(wu)院出(chu)臺有關(guan)(guan)文(wen)件,要求(qiu)打造公(gong)共(gong)數據(ju)基礎支(zhi)撐平(ping)(ping)臺,推(tui)動(dong)公(gong)共(gong)數據(ju)歸(gui)集(ji)整合(he)、有序流通(tong)和共(gong)享(xiang)。住房(fang)城(cheng)鄉建(jian)(jian)設(she)部也在持(chi)續推(tui)動(dong)有關(guan)(guan)項(xiang)目建(jian)(jian)設(she),逐(zhu)步實現(xian)數據(ju)統(tong)一歸(gui)集(ji)共(gong)享(xiang)。《目錄(lu)》發(fa)布(bu)后,明確(que)了信(xin)(xin)(xin)息的(de)歸(gui)集(ji)范圍(wei),提供了目錄(lu)支(zhi)撐。下一步,建(jian)(jian)議還應抓(zhua)緊建(jian)(jian)設(she)覆(fu)蓋全(quan)系統(tong)的(de)信(xin)(xin)(xin)用(yong)(yong)信(xin)(xin)(xin)息歸(gui)集(ji)平(ping)(ping)臺,為信(xin)(xin)(xin)息歸(gui)集(ji)共(gong)享(xiang)提供平(ping)(ping)臺支(zhi)撐;編(bian)制發(fa)布(bu)統(tong)一的(de)數據(ju)標準、系統(tong)標準,為歸(gui)集(ji)共(gong)享(xiang)提供標準支(zhi)撐。
《中(zhong)(zhong)共(gong)中(zhong)(zhong)央關(guan)于(yu)(yu)進(jin)(jin)一步全面深化改革、推進(jin)(jin)中(zhong)(zhong)國式現代化的(de)(de)決定》要求(qiu),構(gou)建(jian)高(gao)水平社會主義(yi)市場經濟體制(zhi),“促(cu)進(jin)(jin)中(zhong)(zhong)介服(fu)務(wu)機構(gou)誠(cheng)實守(shou)信、依法履責(ze)”。工程(cheng)勘測(ce)、工程(cheng)設(she)計咨詢、工程(cheng)造價(jia)咨詢、工程(cheng)監(jian)理、工程(cheng)質量檢測(ce)等是(shi)工程(cheng)建(jian)設(she)領域的(de)(de)中(zhong)(zhong)介服(fu)務(wu)行業,其(qi)誠(cheng)信經營對于(yu)(yu)建(jian)設(she)“好房子”關(guan)系重(zhong)大。住房城鄉建(jian)設(she)部門應用(yong)好“信用(yong)”手段(duan),特(te)別是(shi)對部分取消(xiao)了資質許可的(de)(de)行業,期待加強(qiang)以信用(yong)為基礎的(de)(de)事(shi)中(zhong)(zhong)事(shi)后(hou)監(jian)管(guan)。
另(ling)外,住(zhu)房(fang)城鄉(xiang)建設(she)部門還(huan)應注意,信用(yong)不僅是工作(zuo)抓手,還(huan)可(ke)以為(wei)誠實守(shou)信的中小企業(ye)(ye)賦能,為(wei)其在市場推(tui)廣、招投標、融資、保險(xian)、擔保等(deng)領域(yu)授信,創造良好營(ying)商環境和(he)公平發展(zhan)機會,激發企業(ye)(ye)的內生動(dong)力(li)和(he)創新活力(li)。
問:《目錄》會產生哪些具體影響?
答:《目(mu)錄》發布將更好保障(zhang)市場主體合(he)法權益。《目(mu)錄》清晰(xi)了住(zhu)房(fang)城鄉建設(she)領(ling)域公共(gong)信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)(xin)(xin)息的(de)界限(xian),有效避免(mian)信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)濫用(yong)(yong)(yong)問題。信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)(xin)(xin)息統一歸集共(gong)享(xiang)后,及時、規范(fan)的(de)信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)修復(fu)也可以變為現(xian)實,“信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)手段”將對構建誠實守信(xin)(xin)(xin)(xin)市場秩序發揮(hui)正向引導作(zuo)用(yong)(yong)(yong)。
