國務院辦公廳關于建立健全涉(she)企收費(fei)
長效(xiao)監管機制的指(zhi)導意(yi)見(jian)

各省、自治(zhi)區、直轄市人民政(zheng)府,國務院各部委、各直屬機構(gou):
加(jia)強涉企(qi)收費(fei)監管是降低企(qi)業經(jing)營成本、優化營商(shang)環境的重要舉措,對激發(fa)(fa)市場活力、促進經(jing)濟社會高質量發(fa)(fa)展(zhan)具有重要意(yi)(yi)義。為貫(guan)徹落(luo)實黨(dang)中(zhong)央(yang)、國務院(yuan)決策(ce)部(bu)署,建立健全涉企(qi)收費(fei)長效監管機制,經(jing)國務院(yuan)同意(yi)(yi),現提(ti)出以下意(yi)(yi)見。
一、總(zong)體要求
以習(xi)近平新時代中(zhong)國特色社會(hui)主義(yi)思想為指導(dao),深入貫徹黨的二十(shi)大(da)(da)和二十(shi)屆二中(zhong)、三中(zhong)全(quan)會(hui)精(jing)神,堅持問題(ti)導(dao)向、防治(zhi)并舉、標本兼治(zhi),聚焦(jiao)政府部門及下屬單(dan)位(wei)、行(xing)政審批中(zhong)介(jie)服務機構(gou)、行(xing)業(ye)協會(hui)商會(hui)、經營自然(ran)壟斷環節業(ye)務的企(qi)(qi)(qi)業(ye)等涉企(qi)(qi)(qi)收費(fei)主體,著力優化營商環境(jing),健全(quan)涉企(qi)(qi)(qi)收費(fei)監管制度,加大(da)(da)違規(gui)收費(fei)治(zhi)理力度,強(qiang)化全(quan)過程(cheng)監管和協同(tong)監管,構(gou)建(jian)協同(tong)高效的長效監管機制。
二、重點任務
(一)健全涉企(qi)收費目錄清單制度。行政(zheng)事(shi)業(ye)(ye)(ye)(ye)性收(shou)(shou)(shou)(shou)費(fei)(fei)、政(zheng)府(fu)性基(ji)金、國(guo)務(wu)(wu)院部門(men)涉企(qi)(qi)(qi)保(bao)證金、政(zheng)府(fu)定(ding)價的(de)經(jing)營(ying)(ying)服(fu)務(wu)(wu)性收(shou)(shou)(shou)(shou)費(fei)(fei)實行目(mu)(mu)(mu)錄(lu)清單(dan)管(guan)理,由(you)國(guo)家(jia)發展改革(ge)委(wei)、工業(ye)(ye)(ye)(ye)和信(xin)息化部、財政(zheng)部按(an)職(zhi)責分工制(zhi)定(ding)收(shou)(shou)(shou)(shou)費(fei)(fei)目(mu)(mu)(mu)錄(lu)清單(dan)并向社會(hui)公開。行業(ye)(ye)(ye)(ye)主管(guan)部門(men)要制(zhi)定(ding)本部門(men)及下屬單(dan)位綜合(he)性涉企(qi)(qi)(qi)收(shou)(shou)(shou)(shou)費(fei)(fei)目(mu)(mu)(mu)錄(lu)清單(dan),涵蓋行政(zheng)事(shi)業(ye)(ye)(ye)(ye)性收(shou)(shou)(shou)(shou)費(fei)(fei)、政(zheng)府(fu)性基(ji)金、涉企(qi)(qi)(qi)保(bao)證金、經(jing)營(ying)(ying)服(fu)務(wu)(wu)性收(shou)(shou)(shou)(shou)費(fei)(fei)等收(shou)(shou)(shou)(shou)費(fei)(fei)項目(mu)(mu)(mu),明確服(fu)務(wu)(wu)內容、服(fu)務(wu)(wu)標(biao)準、收(shou)(shou)(shou)(shou)費(fei)(fei)水平,實現每個部門(men)涉企(qi)(qi)(qi)收(shou)(shou)(shou)(shou)費(fei)(fei)一(yi)張目(mu)(mu)(mu)錄(lu)清單(dan)全覆(fu)蓋。各省級人民(min)政(zheng)府(fu)要健全本地(di)區涉企(qi)(qi)(qi)收(shou)(shou)(shou)(shou)費(fei)(fei)目(mu)(mu)(mu)錄(lu)清單(dan)制(zhi)度。各地(di)區、各有關部門(men)要及時更新發布收(shou)(shou)(shou)(shou)費(fei)(fei)目(mu)(mu)(mu)錄(lu)清單(dan),清單(dan)之外一(yi)律不得收(shou)(shou)(shou)(shou)費(fei)(fei)。
(二)完(wan)善涉企(qi)收(shou)費政策評估審(shen)核工作機(ji)制。發展改(gai)革、司法(fa)(fa)(fa)行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)、市(shi)場監管等(deng)(deng)(deng)部(bu)門按(an)規(gui)定(ding)開展宏觀政(zheng)(zheng)(zheng)(zheng)(zheng)策取向一致性(xing)(xing)(xing)評估(gu)、合法(fa)(fa)(fa)性(xing)(xing)(xing)審(shen)核(he)、公平(ping)競爭審(shen)查等(deng)(deng)(deng)工(gong)作時,要(yao)加強(qiang)對新出臺涉企收(shou)(shou)(shou)費(fei)(fei)(fei)政(zheng)(zheng)(zheng)(zheng)(zheng)策合法(fa)(fa)(fa)性(xing)(xing)(xing)、公平(ping)性(xing)(xing)(xing)以及社(she)會預期影(ying)響(xiang)等(deng)(deng)(deng)方面的(de)評估(gu)審(shen)核(he)。行(xing)(xing)業(ye)主(zhu)管部(bu)門及下屬(shu)單位、行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)審(shen)批中介服務機構(gou)、行(xing)(xing)業(ye)協會商會等(deng)(deng)(deng)要(yao)加強(qiang)涉企收(shou)(shou)(shou)費(fei)(fei)(fei)項(xiang)目(mu)評估(gu)論證,嚴(yan)禁(jin)違(wei)規(gui)新設涉企收(shou)(shou)(shou)費(fei)(fei)(fei)項(xiang)目(mu)。市(shi)場監管總局要(yao)會同有關(guan)部(bu)門研究制定(ding)涉企收(shou)(shou)(shou)費(fei)(fei)(fei)政(zheng)(zheng)(zheng)(zheng)(zheng)策評估(gu)審(shen)核(he)和(he)論證工(gong)作指引,明(ming)確職(zhi)責、依據(ju)、范圍(wei)、標準、規(gui)則(ze)等(deng)(deng)(deng);對存量(liang)涉企收(shou)(shou)(shou)費(fei)(fei)(fei)政(zheng)(zheng)(zheng)(zheng)(zheng)策開展專項(xiang)整治,依法(fa)(fa)(fa)依規(gui)清理違(wei)規(gui)收(shou)(shou)(shou)費(fei)(fei)(fei)政(zheng)(zheng)(zheng)(zheng)(zheng)策,違(wei)法(fa)(fa)(fa)違(wei)規(gui)收(shou)(shou)(shou)費(fei)(fei)(fei)項(xiang)目(mu)一律(lv)取消。
(三(san))加強涉企收費(fei)政策常(chang)態化宣傳解(jie)讀。行業主(zhu)管(guan)部(bu)門要常態化(hua)更新發(fa)布本領域(yu)涉(she)企(qi)(qi)收費政(zheng)策,通(tong)過專家解讀等方式加大(da)政(zheng)策宣(xuan)傳力度。工業和(he)信(xin)息化(hua)部(bu)要充分發(fa)揮全國減輕(qing)企(qi)(qi)業負擔相(xiang)關(guan)工作機(ji)制作用(yong),精心組織政(zheng)策宣(xuan)傳周(zhou),定期匯編發(fa)布減輕(qing)企(qi)(qi)業負擔政(zheng)策。鼓勵各(ge)地(di)區(qu)、各(ge)有關(guan)部(bu)門運用(yong)大(da)數據(ju)等手段,結(jie)合企(qi)(qi)業辦理中介服務等事項,向企(qi)(qi)業精準推(tui)送收費目錄指引(yin)以及有關(guan)解讀說明材料(liao),及時解疑釋惑。
(四)健全涉企收費跟蹤監測(ce)制度(du)。各地區、各有關部門(men)(men)要(yao)加強對本(ben)地區本(ben)領(ling)域涉(she)(she)企(qi)收(shou)(shou)費情(qing)況(kuang)的(de)監測(ce),發(fa)揮新聞媒體、行(xing)業協會(hui)商會(hui)等作用,及時了解涉(she)(she)企(qi)收(shou)(shou)費政策(ce)執行(xing)情(qing)況(kuang)和企(qi)業意見建議,推(tui)動(dong)解決企(qi)業關切的(de)問題。工業和信(xin)息化部要(yao)健全完善重點企(qi)業運行(xing)監測(ce)統(tong)計調查制(zhi)度,持續(xu)發(fa)布企(qi)業負擔調查評估報(bao)告。市場監管總局(ju)等部門(men)(men)要(yao)建立涉(she)(she)企(qi)收(shou)(shou)費監測(ce)點,完善相關制(zhi)度。發(fa)展(zhan)改革部門(men)(men)要(yao)探索對實行(xing)市場調節價的(de)經營服(fu)務(wu)性收(shou)(shou)費,通(tong)過開展(zhan)價格、成本(ben)調查等方式,引導有關涉(she)(she)企(qi)收(shou)(shou)費主體合(he)理合(he)規收(shou)(shou)費。
(五(wu))健全(quan)涉企(qi)收費問題線索收集和處理機制。各(ge)(ge)地區(qu)、各(ge)(ge)有關部(bu)門要(yao)(yao)通過在門戶網站設立信(xin)訪(fang)專(zhuan)欄、公開(kai)投訴舉(ju)報電話(hua)等(deng)方式,常態化(hua)收(shou)(shou)(shou)(shou)集(ji)涉(she)企違規(gui)(gui)收(shou)(shou)(shou)(shou)費(fei)(fei)問(wen)(wen)題線(xian)索(suo)(suo)和(he)(he)意見建議;健全涉(she)企違規(gui)(gui)收(shou)(shou)(shou)(shou)費(fei)(fei)投訴舉(ju)報問(wen)(wen)題線(xian)索(suo)(suo)處理(li)(li)規(gui)(gui)定,細(xi)化(hua)完(wan)善(shan)登記、受理(li)(li)、轉辦、處理(li)(li)、反饋等(deng)各(ge)(ge)環節流(liu)程和(he)(he)要(yao)(yao)求;綜合(he)利用市(shi)場監(jian)管、行業監(jian)管、信(xin)用監(jian)管等(deng)手(shou)段,依(yi)法(fa)(fa)加大(da)(da)對(dui)違規(gui)(gui)收(shou)(shou)(shou)(shou)費(fei)(fei)主體的(de)懲戒力度;重(zhong)大(da)(da)違紀違法(fa)(fa)問(wen)(wen)題線(xian)索(suo)(suo)依(yi)法(fa)(fa)按(an)程序移交紀檢監(jian)察和(he)(he)司法(fa)(fa)機關。市(shi)場監(jian)管總局會同(tong)有關部(bu)門加強對(dui)違規(gui)(gui)收(shou)(shou)(shou)(shou)費(fei)(fei)行為查處工(gong)作的(de)指(zhi)導,依(yi)法(fa)(fa)曝(pu)光(guang)涉(she)企違規(gui)(gui)收(shou)(shou)(shou)(shou)費(fei)(fei)典型(xing)案例,對(dui)群眾反映強烈、危(wei)害性(xing)大(da)(da)、具有代表性(xing)的(de)典型(xing)案例,要(yao)(yao)多部(bu)門聯合(he)曝(pu)光(guang)。工(gong)業和(he)(he)信(xin)息化(hua)部(bu)會同(tong)有關部(bu)門按(an)規(gui)(gui)定督促(cu)整改發現的(de)涉(she)企違規(gui)(gui)收(shou)(shou)(shou)(shou)費(fei)(fei)問(wen)(wen)題。
(六)加強(qiang)相關領(ling)域收費規范。各地(di)區(qu)、各有(you)(you)關(guan)(guan)部(bu)門要進一步(bu)清(qing)(qing)(qing)理(li)沒(mei)有(you)(you)法律(lv)法規或國務(wu)(wu)院決定依據的(de)中(zhong)介(jie)服務(wu)(wu)事(shi)項(xiang)(xiang),不(bu)(bu)(bu)得(de)違規新增中(zhong)介(jie)服務(wu)(wu)事(shi)項(xiang)(xiang),不(bu)(bu)(bu)得(de)將(jiang)政(zheng)務(wu)(wu)服務(wu)(wu)事(shi)項(xiang)(xiang)轉為中(zhong)介(jie)服務(wu)(wu)事(shi)項(xiang)(xiang);屬(shu)于(yu)政(zheng)府(fu)管理(li)職責的(de)委托(tuo)服務(wu)(wu)事(shi)項(xiang)(xiang),相關(guan)(guan)費(fei)(fei)用由行(xing)政(zheng)審批管理(li)部(bu)門支(zhi)付,不(bu)(bu)(bu)得(de)轉嫁給企業(ye);清(qing)(qing)(qing)理(li)對中(zhong)介(jie)服務(wu)(wu)的(de)不(bu)(bu)(bu)合(he)理(li)市場(chang)準入限制,支(zhi)持(chi)(chi)和培育更(geng)多經營主(zhu)體(ti)進入市場(chang),促進公平競爭(zheng)。民政(zheng)部(bu)門要配合(he)有(you)(you)關(guan)(guan)部(bu)門持(chi)(chi)續(xu)深(shen)化行(xing)業(ye)協會(hui)商(shang)(shang)會(hui)改革(ge),推(tui)動健全綜合(he)監(jian)管體(ti)系,規范行(xing)業(ye)協會(hui)商(shang)(shang)會(hui)收費(fei)(fei)行(xing)為。發展改革(ge)等部(bu)門要持(chi)(chi)續(xu)規范城鎮供(gong)水、供(gong)電、供(gong)氣、供(gong)暖(nuan)行(xing)業(ye)收費(fei)(fei),清(qing)(qing)(qing)理(li)取消不(bu)(bu)(bu)合(he)理(li)收費(fei)(fei)項(xiang)(xiang)目(mu),配合(he)有(you)(you)關(guan)(guan)部(bu)門推(tui)動競爭(zheng)性環(huan)節市場(chang)化改革(ge)。
(七)健全相關法律法規制度(du)。各(ge)地區(qu)、各(ge)有(you)關(guan)部(bu)門要根據涉企(qi)收費(fei)監管工作需要,加快推(tui)動(dong)相關(guan)法(fa)律法(fa)規制(zhi)定修訂(ding)工作,依法(fa)加強對行政審(shen)批(pi)中介(jie)服務機構、行業(ye)協(xie)會(hui)商會(hui)、經營自(zi)然壟斷環(huan)節業(ye)務的企(qi)業(ye)等收費(fei)行為(wei)(wei)的監管。推(tui)動(dong)修訂(ding)《中華人民(min)共和國價格法(fa)》,研究制(zhi)定涉企(qi)收費(fei)違法(fa)違規行為(wei)(wei)處理辦法(fa)及相關(guan)指南等,完(wan)善(shan)社(she)會(hui)團體會(hui)費(fei)管理等制(zhi)度。
三、加強組織保障
國家發展(zhan)改革委(wei)、工(gong)(gong)業和(he)信息化部(bu)、財(cai)政(zheng)部(bu)、市場監(jian)管總(zong)局要依托相(xiang)關工(gong)(gong)作機制(zhi),會同(tong)有關部(bu)門(men)及(ji)時分析研(yan)判(pan)涉企收(shou)費(fei)形勢,推動解決有關重大問題,強化涉企收(shou)費(fei)政(zheng)策制(zhi)定和(he)監(jian)督檢查工(gong)(gong)作協同(tong)。各(ge)有關部(bu)門(men)要按職(zhi)責(ze)分工(gong)(gong)持續(xu)完善(shan)涉企收(shou)費(fei)相(xiang)關目錄(lu)清單,常態化開(kai)展(zhan)涉企收(shou)費(fei)跟(gen)蹤監(jian)測,加(jia)(jia)大違規行為查處懲戒力度。各(ge)行業主管部(bu)門(men)要按照“誰(shui)審(shen)批、誰(shui)監(jian)管,誰(shui)主管、誰(shui)監(jian)管”原則,嚴格落(luo)實涉企收(shou)費(fei)監(jian)管責(ze)任。各(ge)地(di)區(qu)、各(ge)有關部(bu)門(men)要加(jia)(jia)大對涉企收(shou)費(fei)監(jian)管舉措及(ji)成效的(de)宣傳力度,營造(zao)全(quan)社會共(gong)同(tong)參與、協同(tong)治理的(de)良好氛圍。
